Do any of you own rental property...

SEC. 209. PROHIBITION OF RESTRICTIONS ON RESIDENTIAL INSTALLATION OF SOLAR ENERGY SYSTEM.

(a) REGULATIONS.-Within 180 days after the enactment of this Act, the Secretary of Housing and Urban
Development, in consultation with the Secretary of Energy, shall issue regulations
(1) to prohibit any private covenant, contract provision, lease provision, homeowners’ association rule or bylaw, or similar restriction, that impairs the ability of the owner or lessee of any residential structure designed for occupancy by 1 family to install, construct, maintain, or use a solar energy system on such residential property; and
(2) to require that whenever any such covenant, provision, rule or bylaw, or restriction requires approval for the installation or use of a solar energy system, the application for approval shall be processed and approved by the appropriate approving entity in the same manner as an application for approval of an architectural modification to the property, and shall not be willfully avoided or delayed.
(b) CONTENTS.-The regulations required under subsection (a) shall provide that
(1) such a covenant, provision, rule or bylaw, or restriction impairs the installation, construction, maintenance, or use of a solar energy system if it
(A) unreasonably delays or prevents installation, maintenance, or use;
(B) unreasonably increases the cost of installation, maintenance, or use; or
© precludes use of such a system; and
(2) any fee or cost imposed on the owner or lessee of such a residential structure by such a covenant, provision, rule or bylaw, or restriction shall be considered unreasonable if
(A)such fee or cost is not reasonable in comparison to the cost of the solar energy system or the value of its use; or
(B) treatment of solar energy systems by the covenant, provision, rule or bylaw, or restriction is not reasonable in comparison with treatment of comparable systems by the same covenant, provision, rule or bylaw, or restriction.

Taking away your property rights if you own rental property – the lessee can slap solar panels on the roof and you can’t stop it.

This is part of the 300+ pages that were added to the bill at 4:00am Friday–14 hours before the voting started. And you know your Congressturd didn’t have/take time to read the damned thing!!!

I’ll bet you are pissed off at the government that you are also required to maintain a roof and a heating system in the house and provide a friggin’ stove, no doubt soon they will force you to rent it to black folks too! Jeez, what is this country coming to with all this damned government intervention?

You’re wierd, sir.

Do you have anything relevant to say ? You liberals always play the race card when the cupboard is bare.

What? Someone who rents can demand you allow cable TV to be attached, a standard 18" satellite dish installed and phone land-line service be installed and there is nothing you can do to stop them either, take a look in the mirror if you really want to gaze on weird.

Now, we can really escalate this into full down & dirty name calling if that is where you want to go and you I’ll never back down. The ball is now firmly in your court, leap if you are feeling froggy.

Repubtards normally play the liberal card, screw you and I raise two bucks.

You’re weird, sir.

“Leap if you are feeling froggy”???

I heard that several days ago on some local Re-pubic-an debate or something. Not very interesting discussion, as would be expected, but that one phrase pricked-up my ears.

I accept your retreat. :stuck_out_tongue:

Better to light a candle than to curse the darkness.

Reality bites Joe.:frowning:

“Panic appropriately.”

I can imagine one of my residential tenants tenants installing a solar powered ventilator is the attic without my permission or knowledge (not very likely, but it could happen) - what they’re *not *going to be doing is spending tens of thousands of dollars of their own money to install photovoltaic generating systems or solar hot water systems at my properties.

Agree
I currently rent and I don’t even want to pay the lawn companies to treat my lawn for crab grass. I do not want to invest in someone elses property. I pay my rent and I keep the place maintained. recently my landlord installed covers over my window wells now I got weeds growing up in my window wells and am having a hard time convincing myself to buy some sort of mulch or rock to supress the weeds, as this would be a cost sunk into a property that I do not own. There is no way as a renter that I would pay to install panels on a rental unless I can take them when I leave without damage to the roof.

Currently Lessees have the right to make improvements to your property for the purpose of ADA. The rub on that for the lessee is that they are required to restore the home to its original state if the owner requires it, and it’s not considered “unreasonable” to have it restored afterwards at the Lessee’s expense. Maybe you can’t stop it, but no tenant is going to want to pay to restore it afterwards, so it likely would never be done.

Liberals are masters at the use of the Straw Man argument. You resent government interference therefore you must be a racist.

I think this part is to promote the possibility of “Green” and “Clean” environment…doesn’t matter who pays for it. But you’re right, guys…ain’t no renter gonna pay thousands of bucks to improve someone else’s property.

But, if this can happen, where would it stop? It could even be construed to include small things as well.

No matter what, it is still a slap against property rights or owners, regardless of its liability or feasibility.

This guys says pretty clearly what the problem is.
