In short the answer is no, such NACHI activities are perfectly legal as we qualify for several exemptions. Calling NACHI members, even those listed in the Do-Not-Call registry, is exempted under established business relationship. Calling non members, even those listed in the Do-Not-Call registry, is exempted as the callers, working for our non-profit organization, do not ask for money. They are simply passing on pertinent, timely, and local inspection information to inspectors and so such activity is exempted under non-commercial.
