The person who signs the inspection agreement is your client - yes?
If the real estate agent, being the representative of their client, signs the agreement - who’s my client then?
The client is your client. The agent is working as the client’s “employee” or authorized representative. Everything they are doing is on behalf of the client and in their name. Just have the agent sign their name followed by a title (ie authorized agent).
The bottom of my inspection agreement has a line - for a signature.
Under the line is “Client or Client’s Representative.”
Scenario: The home buyer can’t make it to the inspection, and there’s no time or method to get their signature on the agreement before you perform the inspection. Your client’s real estate agent is there. A blood relative of the home buyer is there (let’s say… the concerned father is there).
- What do you do?
- Who signs the agreement?
- Will you provide a copy of the report (or summary) to anyone at the property?
Yes I would Ben, otherwise it would be pointless for me to be there, I don’t really care who signs it as long as they understand their representing the buyer, which they are because their at the inspection because the Buyer cannot be.
I don’t make a mole hill into a mountain or try to make someones life problematic for no particular reason, I’m still going to inspect the house the same way and probably give the agent a copy of the report anyway, I can only remember once in the last few years a client didn’t want his agent to have a copy, that was because he was backing out of the deal and firing his agent.
I always ask if they want me to send a copy to the Agent and there have been many times I was hired over the objection of the Agent that wanted a guy off there list to do the Inspection.
Those are the clients that want the report sent only to them.
They have a Lawyer and that is the person it really needs to go to.
Is the Agent going to play Lawyer and negotiate with the seller?
the agent almost wants a copy everytime here. My contract states that the client gives permission to release to the realitor.

In the southern half of NJ, agents and title companies handle the closings. In the northern half of NJ, lawyers handle the closings. The system is weird, but it has been that way for some time now.
It is in my contract to be in compliance with the NACHI code of ethics. In the St. Louis area, the agents virtually ALWAYS get a copy of the report. When I was an agent, I kept the reports along with everything else in regards to the transaction for 7 years as required by law. I also do that to help me serve my client better. It’s always a pain in the *** when a contractor or realtor calls for clarification, and I have to refer them back to the buyer. This way, I can just clarify and go on. I have yet to have a buyer who didn’t think that was great.
When I am going over my agreement with the client, I tell them that this is the only part of my agreement that is negotiable. If they wish, I will strike the paragraph from the contract. In the two years I have had this in my contract, I have yet to have a single client ask to have it removed.
Now, all that being said… Loose the attitude. :roll:
I have a spot on my agreement that ask if the clients realtor gets a copy or if they don’t get a copy. I have never had a client not mark the “give a copy to my agent” I also have a spot that asks who the agent is and what real estate firm.

I had an agent try to tell me that I had to supply a copy of the report to him under Wisconsin law when it is actually specifically prohibited without the clients consent.
I would never give an agent my report unless it is given to him by the client.
So would you say. That letting your client distribute the inspection report. As safest way to handle that situation?
