In court (and The Good Lord knows I’ve spent a lot of time in court)… you don’t want to come off sleazy to the judge.

So sneaking in clauses that gets your client to agree to crazy stuff (like the technically exhaustive $5,000 inspection option) can work against you.

Just explain that a home inspection isn’t technically exhaustive and that you don’t offer that service because it is not a service anyone is able to provide.

It’s almost as nutty as putting in a clause that gets your client to agree that you (the inspector) can unilaterally change the terms of the agreement later without your client agreeing to the changes.

That would be awesome! But no judge is going to go for that. And if the judge notices such an unconscionable clause, it’s not going to go well for you. Your agreement doesn’t have to be fair to the consumer, it can favor you… but it can’t be absurd.
