Code of ethics is away when we all should carry yourself. Always doing the right thing always been professional always treating people equally cuz we’re all equal as human being. And making sure we all do our job right that’s what I think code of ethics is.

Home Inspectors can limit their liability by following proper policies, and having a written contract of the services being provided. Then taking the time to explain and manage the clients expectations of what can be discovered during a visual inspection. If a client understands what a home inspection entails, what is reasonable vs. what is impractical, then liability and litigation can be reduced.

The service panel. Many new home buyers are no familiar with the service panel in their home. Most people are afraid of electricity. You can ease their fears with a little explanation. Point out the main circuit breaker and the rating. Explain how to look for a tripped circuit breaker and reset it.

Home Inspectors are not “experts” , we are more of a "generalist’. Experts tend to focus on one thing. It is better to be a well rounded and balanced Inspector of multiple backgrounds, to better help our clients understand the issues at hand.

If a client would suggest “going easy” on a segment of the inspection, I would inform he/she that this would not be in-line with industry accepted ethical practices. Additionally, inaccurate reporting of the actual condition(s) could result in a potential liability to the client down the road.

I plan on doing business in an area that could potentially draw clients from two states (aside from the state my LLC is registered in). I will use the recommendation from the article regarding “Jurisdiction” and add specific language to my website indicating that any business transaction only applies to the state the LLC is registered in.

In addition to violating State law such action would also violate InterNACHI Code of Ethics that require members to abide by all laws of the jurisdiction in which we operate. So it is unethical to report code compliance issues to our clients.

As a corporation my business is a separate entity from me and therefore I am not liable in most cases for the companies liabilities. I must however keep financial things separate. For example we must have a business account to handle business expenses and revenue.

Inspectors are always at risk of getting sued by a customer, so certain safety percaucions and photo graphical evidence is extremely important such as using a STOP or STAY BACK sign. This sign can keep customers a safe distance away from your current location and equipment, it can also show you are not reckless in court. It is also important to always take three photos before, during, and after the inspection of a watermeter to insure you did not cause any leaks.

Inspection of a home is also a visual inspection of the roof of a home. Sometimes the home seller will ask the inspector to go easy on the condition of the roof. I prefer to inspect a roof with a drone whenever the weather permits. I would kill em with kindness as they say when talking to the seller of the home and advise them that I video and take pictures of entire roof structure and will include findings in my report that the buyer paid for.

There are dangers in calling yourself an expert in certain areas of a home inspection. A court can hold you at a higher standard, due to the inspector claiming a higher standard of care. Upon doing so the inspector is at potential risk for lawsuits for breach of contract by failing to provide expertise the inspector claimed to posses.

This is an easy situation to resolve. I would explain to the seller that my job as an inspector was to be an honest, impartial intermediary between buyer and seller and therefore my duty to both them and my professional association is to give a truthful representation of the condition of all items in my inspection.

The seller is not my client, so I would perform the roof inspection as I usually do by adhering to the Standards Of Practice of InterNACHI. I would also show no biased to either the seller or client even though I am working for my client.

I read the article, Easy Steps That Help Home Inspectors Avoid Lawsuits. I learned that courts now hold inspectors to the claims they make in their marketing. Also taking three photos of the water meter at an inspections is something I will definitely use in the future or maybe a video at the end to show there were no leaks when I finished the inspection.
