Hypothetical Situation With a Conflict of Interest

The inspector is working with a long time realtor friend on an investment inspection. During the inspection dozens of dead **** roaches have been found. The realtor also asks the inspector to put in the report that carpenter ants have been seen and there is some evidence of damaged wood as a result. This is to help aid the realtor to try and get an even lower price for the property. Of course, the inspector should not put in the report anything that is not true.

A realtor who I consider a friend of mine refers me to a potential buyer to perform an inspection on a house. I am aware that the realtor has been struggling financially and I know that this deal would really help out. If I were to fail to report on the true condition of the house in order to not “kill the deal,” I would not be acting in the best interest of the client. Although I want to stay in the good graces ofthe realtor, my first responsibility is to the client/potential buyer and be truthful and accurate on the condition of the home.

The area I chose to focus on is the inspector safety area. As inspectors, we have to remember that safety is a huge priority not only for ourselves but for others as well. Wether it be in a crawl space or an attic, there are a multitude of things that could be dangerous at any given time. Specifically, the picture of a ladder with a broken rung. This could pose a threat while climbing or coming down from an attic, possibly resulting in serious injury. We want to make sure we are always keeping it safe and representing interNACHI well with every choice we make

A situation that one would say would be an ethical violation would be a realtor asking me as the home inspector to not bring too much attention to the cracks in the foundation. Of course, this would be unethical and I would report any deficiencies accurately and to best of my ability.

An example would be if I was about to do an inspection for a potential home buyer. I arrive at the house to meet the client and find that they have a different skin color then I do. I decide to charge them extra or not do the inspection at all based on the color of their skin.

I (Jeff Gardner) was asked by the listing agent of property at 123 Main Street Anytown, USA to overlook some "outstanding issues on the property.
the agent went on to say that the property was owned by a personal friend, and that the property had been on the market for an extended length of time.
The agent stated that if I could possibly “ASSURE” that no issues that would obstruct the sale would arise, that I could be compensated respectively for those services.

I informed the agent that my morale and sole obligation was to the client/potential buyer, and that I was contracted to perform and supply an unbiased and true inspection of the residence and it’s accessible components. I further stated that as a Certified Home Inspector that I would not perform any action that would bring discredit to the profession as a whole or jeopardize my integrity as an Inspector.

I was doing a home inspection for a client. After awhile they started asking me to add items to the report hoping to get the seller to pay for some upgrades that they would eventually like to do. The client said he would offer to pay extra for me to do that.

This would be one of the times I would go against what the client would want.

It is always best to have the client sign the inspection agreement prior to the inspection. Although sometimes it is not possible for the client to be present at the time of inspection. If the agent does have authorization to sign on behalf of the client you should have them write “Authorized Agent” under there signature. The inspector should also try and contact the client to make sure the agent is authorized if possible. If for some reason the client can not confirm or fails to find out if the agent has authority there are things like assumed authority and implied authority. Both of these may give the inspector a way out if the client were to say that the agent did not have authority.

-Although only required to inspect an appropriate representation of outlets, I believe checking all that are accessible is beneficial. An Inspector finding that one outlet in the house that is ungrounded or has the polarity reversed can be important for the client. Not only could the issue cause damage to the house, but also potentially to expensive or significant items plugged into those outlets that the client assumed were proper because the “appropriate representation” was proper.

I was doing my report and i noticed lots of dry rot in the back of the house on the facial board. I also noticed there was no drip edge attach to the facial boards. The Agent ask me not to report. I Said i had to. I have to be honest and my duty is to report my findings to the buyer.
