Looks like a 250 amp to me
Judging from the second photo (below) I would guess that this was a factory installed jumper for a non-fused disconnect which would fine if an OCPD were not required. The copper tubing in the first photo is an obvious violation.

Depends on what the melting point of copper is.
Perhaps in Chicago it is OK
