Yea, I don’t even want the “perception” of conflict of interest. I’ll never do any inspections for my wife as a realtor. It’s just not worth the “potential” trouble. It’s like agents that do dual agency representing the buyer and seller in same transaction, it’s just asking for trouble down the line.

Yes, I agree… I would never mix the two. Realtor vs. Inspector… Gotta keep them separate. I would never inspect wife’s transactions either. The perception and conflict of interest is too much of a problem.
If one’s wife is a real estate agent it is absolutely a financial conflict of interest to inspect her listings. For the following reasons it isn’t as ambiguous of a claim to assert:
If she closes on the home the money goes to the same household, simple as that.
It seems to be pretty cut and dry that inspecting your wife’s listings would be in direct violation to those pesky words “ 1. have any disclosed or undisclosed conflict of interest with the client;
2. accept or offer any disclosed or undisclosed commissions, rebates, profits, or other benefit from or to real estate agents, brokers, or any third parties having financial interest in the sale of the property; or
3. offer or provide any disclosed or undisclosed financial compensation directly or indirectly to any real estate agent, real estate broker, or real estate company for referrals or for inclusion on lists of preferred and/or affiliated inspectors or inspection companies.”
Inspecting your wife’s listings would mean you couldn’t share finances at all. And because you both live in the same house any payment on bills by either of you could be classified legally as a financial incentive. I can see it now, “I am not paying the mortgage unless you take those defects off the report”! Or “No honey on the biscuits unless you take those defect off the report”! Pretty easy to see how it could easily venture into some shaky territory.
Let’s be honest people, inspecting even for the same brokerage could directly affect your wife’s income, as it could be clearly argued she may get more listings or leads due to your work for her brokerage even if she is a junior agent in the brokerage. Seems to be a financial benefit to you both that could breed less than honest business practices and exert undue influence on your inspecting practices! Should a client sue, it could be argued your whole llc protection is null and void. Why? Because you mixed both your home and business by working a deal with your wife or her brokerage. At best the legal arguments defending you on this are shaky and at the worst the argument against this being a conflict of interest is not a defendable argument.
ironic that the shady deals will go down between unmarried realtors regulary but a married couple is viewed as unscrupulous. I’ll take a talented married couple over the crap I see in the field.
