In a situation like int he example, my opinion is to not respond to the remark and carry on with the inspection as you do in general. in these type of situations, agreeing to the remark will conflict with your inspection guidelines, interNACHI certified education and overall objectiveness. disagreeing on the other hand can escalate the situation to unpredictable situations. in conclusion abiding by your education, purpose and objectivity is the key.

Arriving at the sellers home
So before I began the inspection on the exterior of the home the owner approaches me and says he needs to talk. He goes in on telling me how great the home is and he is trying to get top dollar for it. He reaches into his pocket and pulls out a 100-dollar bill and says, Here is a little something extra, go easy on the roof. I gratefully smile and reply, Thank you sir but you keep it for your next house.
This would violate the Code of Ethics
The InterNACHI member shall be fair, honest, impartial, and act in good faith in dealing
with the public.

How to Legally Operate a Drone for Home Inspections

There are many requirements to organize before operating a drone for home inspection use.

  1. In 2016, the FAA established rules over commercial use of drones. They require a commercial drone operator to maintain the following: A Remote Pilot Certificate, register drone, and abide by rules regulations and laws.
    a. To obtain a Remote Pilot Certificate you must take a 60-question test
  2. Other state and local laws apply, be sure to do due diligence to be sure youre operating within the law.
  3. Be sure you take the following steps prior to taking off:
    a. Check business insurer covers drone operation
    b. Add verbiage to inspection agreement outlining drone operation
    c. Have your FAA paperwork with you
    d. Make sure your drone is marked per the FAA
    e. Make sure the drone is in flyable condition

When meeting with a realtor recently, I was asked to go easy on the home and not document any “maintenance” items. I informed her that I will document all with comments that reflect the item as “maintenance” and subject to repair as warranted by the buyer. The report is a reflection of the condition of the home and should be presented as such.

Being fairly new in the industry, I have found great value in the Inter-NACHI message board, along with other social media forums to build confidence in my report writing and to insure that I am following the standards set forth in the industry. I would recommend to all new inspectors that they utilize the experience that exists out there and the others that are more than willing to share.

Agents relationship with a home inspector really comes down to the agents need for the inspector to not kill the deal. While this could be a genuine way of saying “be honest but not harsh”, it could also mean “go easy”. It is the responsibility of the inspector to walk that line of being honest in their reports, but presenting it so that deals still go through and so that agent/inspector relationships continue.

A real estate agent can sign an inspection agreement on behalf of the client if they are an authorized agent. In the event that they are not formally authorized, they still could sign with apparent or implied authority that the court has continually held up. However it is still best if the client themselves can sign the agreement.

Prior to the inspection I would inform the home seller that their request to go easy on the roof would be a conflict of interest to all parties involved. I would also inform the home seller that by not reporting the existing conditions observed during the roof inspection would be a in violation of my contract and code of ethics as a business owner.

Claiming to be an Expert…
It is wise not to ever claim to be an expert in the home inspection arena. Just that mere word can cause you a lot of grief. If a home owner ever feels like you misrepresented yourself by being an expert in your field it can get you sued. So If you need more info about this you need to read InterNACHIs Standard of Practice.

Calling yourself an expert home inspector can make a client assume that inspecting a home means going above and beyond the normal aspects of home inspecting. So if something happens or is found later on after the home inspection the client will assume that the home inspector claiming to be an expert is negligent in either not finding it or reporting it in his report. Therefore filing a lawsuit against the home inspector.

The best practice in protecting your company against clients claiming negligence would be to provide as much information in your inspection reports as possible with photos that define any defects or issues that should be investigated further by other professionals. Have them sign the inspection contract prior to starting the inspection which includes the scope of inspection and will be preformed per the standards of practice with the international association of certified home inspections and within the local jurisdiction that the property is located in and providing the homeowner with a home maintenance manual which will help them maintain the home.

Attic, Insulation, Ventilation inspection.
I always inspect the attic before I get on the roof. While inspecting the insulation, ventilation, interior systems, and related components I also inspect the roof decking or sheathing for any sign of water damage or delamination. This allows me to determine if the roof is strong enough to support my weight. I don’t want to get hurt or damage the property. Another advantage is that if it is summer in Alabama the attic is going to be very hot. I get this done and out of the way so I can cool down as I finish.

I just read a great article on a RESPA-Compliant way to give a Real Estate Agent a Gift Certificate.
It was submitted by Nick Gromicko and it is a great way to give agents a gift that doesn’t violate any ethics or laws. This looks like a great idea and Nick gives very good instructions on how to set it up. I’m definitely going to give this a try.

If a home inspector identifies a situation with a home that potentially has two options, the home inspector needs to present a summary of observable facts correctly based upon ASHI guidelines. From this summary, the inspector can provide a recommendation on how to resolve the matter based on the facts and in a manner that does not lend to any biases’ or judgments that might compromise the inspector’s ability to assess in a fair and prudent manner.

I would still call out the issues with the roof, but then maybe bring attention to the fact that it needs to be reviewed by a roofing contractor to evaluate further. This actually is the preferred method sincew it can and must be checked by a professional.

The seller of the property being inspected told the inspector that he would give him a $500.00 “bonus” if he would overlook the faulty wiring in the breaker panel. As an InterNACHI home inspector the bonus was immediately turned down and the panel and wiring was inspected to code and found faulty.

Electronic Signatures for Home Inspection Agreements are being used with greater frequency in today’s society. At times, inspectors are wary of electronic signatures to be legally binding. There is increasing evidence to protect the inspector if appropriate language is inserted into the agreement that states electronic signatures are binding. At the very least, it is nearly impossible for a customer to argue that a binding agreement did not exist in every state provided that the customer faxed their signature to the inspector or agreed to the terms of the agreement by email or text.
