Is it illegal to offer realtors a 100 dollars for 4 inspection referrals?

It was emailed directly to several real estate agents I know. They passed it on to me. If this Iis an NACHI member, where are the ethics guros?

My question would be “Why isn’t this stuff clarified prior to law acceptance?” If this was the FIRST time the Tally’ group have come across this than that I could understand but the R.E. industry has been regulated since 1908, so it’s not like there wasn’t any exposure to situations similar.

They will not investigate the alleged violation unless someone submits a formal complaint. A copy of the flier would be helpful if submitting a complaint. It would also help when submitting a complaint to NACHI for an ethics violation.

You may be correct that DBPR will not do anything regarding a complaint relating to kickbacks. If they were to take action on this violation, they would effectively place themselves in a moral contradiction. G.W. Harrell of the Division of Professions has carefully crafted his declaratory statement (see link in post above) allowing and sanctioning kickbacks to insurance agents and brokers for inspection referrals. While he goes to great lengths in an effort to support his legal theory to distinguish insurance agents and brokers from real estate agents and brokers, a kickback is a kickback is a kickback. His dec. statement effectively undermines the spirit and integrity of the home inspector licensing law. Enforcement of ethics violations after his ruling sanctioning kickbacks would appear to be arbitrary and capricious. Right now, it is more likely that a home inspector will be investigated by DBPR for failure to “test” a wine cooler at a summer kitchen then colluding with a realtor or providing kickbacks.

Like all InterNACHI committees, The Ethics Committee had once been manned with volunteers, today it would be literally impossible for NACHI to attract any suitable members to this once highly regarded committee other than to assemble a kangaroo court to carry out its own nefarious agenda.

The Ethics Committee still exists and still functions. If there are complaints they will be handled as they have been since the beginning of this organization. If Nick or Chris decide to ignore their recommendations, there is nothing the Committee can do other than voice their disapproval.

Posting on the message board means nothing. If you have a formal complaint, forward it, IN WRITING, to Committee Chair, Joe Farsetta. Make sure you provide any proof along with your complaint, as well as the sections of the COE you feel have been violated.

Is it still a dictatorship .
A group who allow no appeal.
A group who allow no defense.
I expect it still is a farce and has no idea on how to do things correctly.

Lies where excepted by the committee .
It was strictly a kangaroo court and should be a banded for the betterment of NACHI .

You don’t know what you are talking about. You are bitter because of your own case, a case where you had complete control of your own actions. You made a conscious decision to act the way you did. Those actions, YOUR ACTIONS, resulted in your ban.

I have personally talked with “members” of the committee and have to agree with Roy.

You have managed to totally discredit anything you have to say.

I too have talked with NACHI members who feel the same and one ESOP member who said the same thing .
It is sad that NACHI does not have a good independent system of handling complaints .
In most cases a simple warning to the offending party just might improve our forum big time .
It is sad to see so many great members seldom post and we seem to have lost some of the best.
Getting rid of some of the useless attacking trash post’s would be great.

The problem always starts at the top and that is where you will find the best solution. When I even try to rationally discuss an issue with “members of the committee” they/he got insulting and condescending. This goes back to the “Conspector”, Florida licensing laws and “insurance inspections(Nachi Management”). The “ethics committee” is a reason for the Distinguished Inspector Society.

It would be great to have some good discussion on this and with a little luck we might get some action to have a proper discipline committee formed.

Yup, some of us will need to die before that hatchet is ever buried, or so say the ‘Council of Men’. :lol:

I’m confused, satisfied with what, the Thornberryization of NACHI, or home inspector licensing? Two of the worst despicable things to befall our profession.
