One more sub-panel question

In my area there are quite a few pools which are served by a pre-wired panel usually containing at least(2) timers, (2) 2-pole breakers and one or more single pole GFCI breakers. Almost without exception, these panels are powered using 2 conductor w/ground Romex, instead of 4 conductors that would allow separation of ground and neutral. I consider these to be sub-panels, of course, but given that they are not located in a separate building, I am wondering if the pre-2008 exception for neutral/ground applies. Thanks

The use of NM as a feeder to a pool is incorrect. The ground must be insulated and NM is not allowed outside in wet areas.
