The problem is "bathtub space" is not defined. If it is a vertical line from the inside tub edge to the ceiling or shower curtain rod, this guy might be "hold your nose" legal. There is no distance requirement if it is not in the tub space.
I hope it was GFCI protected.

Not GFCI protected, non-grounded receptacle that is inside the shower curtain when the curtain is closed.

Nice shot Tim, and a clearer violation than some bathroom outlets, could you do me a favor and either upload that shot to the picture library or email it to me (full size please) I'm sure that it will come in usefull educationaly.
