Bathroom light switch question

I have a question about a wall switch to operate both room lights and an exhaust fan. The switch is planned to be at the end of a 60" tub as shown in the attached file.
The question is… is it safe and is it to code?

Yes, that particular switch is fine. As long as it’s outside the shower area, it’s GOOD.

The switch location requirement is found in NEC 404.4, the last sentence…

“Switches shall not be installed within wet locations in tub or shower spaces unless installed as part of a listed tub or shower assembly.”
