Florida Home Inspector Coalition update?

Steve, the DBPR can (within its authority) and already has, prohibited this for all HI licensees, and the DBPR doesn’t know or care if the HI licensee holds other licenses. The rule is for all HI licensees. Do you disagree?

Where is that in writing? Also, the new Gov. has halted all departments from making rules- until further notice- if I am not mistaken.

To further expand, Chapter 120 of the Florida Statutes has the language that enables governmental departments such as DBPR to make rules. The statute also outlines the limitations that “rule makers” must abide by. With that said, the home inspector licensing law specifically allows contractor/inspectors to offer repairs. DBPR cannot legally make a “rule” that conflicts with provisions in the law. The rule making process only allows them to interpret the law as written and develop rules to implement the law. Check out FS 120.536 and FS 120.54 for further clarification.

It’s in the C.o.E. which hasn’t been officially adopted yet. Maybe this is why there is the delay… and maybe you are on to something. I’ll look into it.

Nick as always your help is appreciated. But the problem is that I thought this was the purpose of the people in the “coalitions” position? I could be wrong, but this is the exact stuff people push through and we are left to eat it.

Is there anything we can do to see these items in the future? Apparently counting on people who said they were there for this EXACT purpose has failed us AGAIN.

If it wasn’t for Mr. Taylor this could have been huge. Hopefully there is something we can do and I am willing to help in any way. Just guide me in the right direction.

One of the heads of the coalition is Bob Farr who sits on the board of the Florida Association of Home Builders, any coincidence noted?

Joe - I brought all of this up at the last meeting and was assured time and again, everything was under control and was going to be “taken care of”. I do see the conflict of interest, big time.

But now that we have a situation. What is the first step? Besides to organize. The implications of this can be catastrophic for our industry.

It seems they are trying to sneak something in under the wire and thanks to Mr. Taylor it was found and brought to our attention.

Anything is possible, but I doubt it. On the other hand I did hear a rumor that NAHI will be there offering free horoscope readings. :wink:

I am disappointed that the"coalition" has not taken the lead on this issue. Perhaps the “coalition” could put out a “call for action” like FAR and/or FHBA does for their members. Perhaps the “coalition” could develop a standardized letter or talking points for all real inspectors to use in a letter and email campaign to their elected representatives across the entire state that highlights the injustices currently being perpetrated against a once honorable home inspection profession by special interests (FHBA, FAR,the insurance industry lobby, and for profit schools selling education) seeking to take control of our profession.

Perhaps Steven Taylor can take the lead on this and I am willing to pitch in to compensate him for his time.

I do not trust the FL Coalition Representative any more, at all. They told me I was stupid for even worrying about the SOP and the COE. As a matter of fact I was told by Nick not to worry about it as well and that it was damn near done deal. Guess all deals are not done, until the papers are signed.

This is exactly what happens when people get appointed to something they know nothing about. I heard the famous Mr. Bushart state time after time, people charge what they are worth. I think out coalition member gets paid nothing and I still think he overpaid!

I would rather chip in some money and have it done right. Its better than free and not done at all but leaves a perception something is being done.

People, you need to understand how the FL legislature works. Each member has a certain # of bills he can introduce, then each bill must go through 3 readings. Each reading has prerequisites and the bill must pass through what ever committees are relevant. The bill can be dropped at any time up until after the third reading. then it must still pass through BOTH the house and the senate and then the Governor.

  I believe this is the first reading. If so unless you know the rep that's sponsoring the bill there's know way to know it's coming up till now. I'm saying all this just to let you know there's time to stop this thing. It takes letters and faxes and phone calls to the reps. and senators in each area and a concerted effort is the only way to get that done.

 Having said all this, what we need is some one watching for bills such as this and sending all the Florida members "call to action" notices. The idea of a letter we can each forward doesn't work because they disregard form letters. What's needed are talking points we can each put in our own words, this has proven the best way to get their attention. And yes Russel, your right, those kind of poeple usual get paid for thie efforts.
