The 5/8 for ceilings is new for the 2003 IRC ... it was 1/2 gypboard prior to that. That is unless your area has more restrictive requirements (like mine) ... 
And those provisions are just a guide for older existing homes ...

Absolutely correct.
In this particular case, if he were to cover the walls (assuming they are not covered), he would have to meet todays standards in doing so. If they are already covered, leave 'em alone and move out
