A question has been presented and now is causing some issues in my area. If I am writing professional opinions on poor workmanship and talking to my clients about how it may be functioning or not causing a problem at the present but will affect the longevity of the home or the work completed. I am now being denied access to do inspections on some properties by specific realtors and flippers or contractors for this specific reason presented to me in writing on denial of access. Opinions needed.

Definetly learning . Is this common then and can they legally or ethically deny a buyer from using the inspector of their choice.
In a regulated state, normally, only the seller can deny you access. If there is a contract in place that allows the buyer a right to inspect using a home inspector, they are violating this agreement. This is best addressed with an attorney practicing RE law in your particular state.
In Ohio, no they can’t. Saraf v. Maronda Homes, Inc. of Ohio. They might have this where you live.
Yes this is my understanding also . Currently also looking for the right attorney to answer and help with this.

Yes Responded in denial of Showing time request. Quote (Inspector should not provide opinion on craftsmanship on the home therefore cannot inspect any of our property’s going forward)

Going as far as I can. The realtors that use me are not happy and say they are filing grievences also. Very bad situation but I feel as an inspector with over 30 years of carpentry / construction and owning my own buisness and now full time inspector for over 5 years. I am qualified to definetly give that opinion and the clients need to know and be educated during the inspection. Especially first time home buyer that are relying on my opinion.
LMFAO. It is you that has the grievance. You may want to talk to your attorney for advice.
They are filing because their inspector of choice is not being allowed to protect their clients.

I would get in contact with the Realtor/s’s Broker and discuss the situation with them, mention that you are thinking of hiring a lawyer and I would be willing to bet this will pass. They may not refer you, but they won’t stop your clients from hiring you to inspect ANY house they may want to have inspected.
Unfortunately I have spoken with Managing Broker . Not mentioned lawyer yet but broker stated this particular realtor owned the flip property and could do anything they wanted . Reached out to owner to try too resolve and they refused to speak with me. I appreciate the responses and was really wanting to make sure I was correctly in inspection standards like I think I am.
Possibly you are going too far, however without actually seeing what you mean exactly by commenting on poor workmanship it is hard to guess, if you want to email a copy of a report that they don’t like to info@inspectnb.com I could tell you what I think.

Steps to handle this.
- Get a really good Attorney!
- Sue the crap out of them for $10M - $20M
- Retire on your winnings and never look back!!
First thing I would do is call the Broker and let them know you feel you’re being discrimated against. Then call the local RE Board, then the Indiana State Realtor Board and file a complaints with them, then I’d be calling all of the local news channels and telling them about how you’re being blackballed by certain individuals or companies and the reasons why.
There may be legal actions you can take as well, but that would be a discusion between you & your attorney.
