Any potential client who’s judgement is poor enough to accept these terms is bound to become a headache.
If the client’s not sophisticated enough to protect their own best interests, why would I want expose myself to their equally poor interpretations of my liability on in the future?
That’s where my Law Degree comes in handy. Pretty sure I cover my butt and not say I’ll never have a disgruntled client that want’s to take me to court, but I assure that that I’ll have already covered all my basis.
There are arguments and scenarios on both sides of this. Keep in mind it comes down to perception. Could the action at any time be perceived as unethical behavior? Ethical or unethical behavior, whether real or perceived is what it comes down to. Remember a persons perception is to them reality.
Plenty of shady attitudes in this conversation. Being ethical is the one thing most important in this industry and the shadiness only takes away from the Professionalism.
