Sharing an Inspection Report With Realtor

I like this answer, a lot. I’m weary of changing anything in my PIA (Internachi/Elite MGA) that the insurance company sent me to use, so this avoids that.

Just take that line out of your agreement. It is your business you can write the contract any way you want it. I can’t see how having that clause provides any protection for you. Get rid of it.

I have added and changed and deleted things in my agreement over the years as I felt a need to do so.

By initialing here (M.S.), you authorize us to distribute copies of the Report to your real estate agent directly involved in this transaction, who are not designated beneficiaries of the Report, intended or otherwise.

I hereby authorize the inspection of this Property having read and understood this Agreement:

A little wordy

Our inspection and report are for your use only. You give us permission to discuss observations with real estate agents, owners, repair persons, or other interested parties. You will be the sole owner of the report and all rights to it.
We are not responsible for use or misinterpretation by third parties, and third parties who rely on it in any way do so at their own risk and release us (including employees and business entities) from any liability whatsoever.
If you or any person acting on your behalf provide the report to a third party who then sues you and/or us, you release us for any liability agree to pay our costs and legal fees in defending any action naming us.
Our inspection report are in no way a guarantee or warranty, express or implied, regarding the future use, operability, habitability or suitability of the home/building or its components. We disclaim all warranties, express or implied, to the fullest extent allowed by law.

I agree and after re-reading the agreement and reading many of the posts, I now believe that I still need written permission to share the report with my client’s REA or attorney. The other posters on this topic have shared many great practices and I will be implementing one or more of them immediately :smiley:

Edit: My area is different than most though…pretty much all of my inspections are pre-listing inspections and the homeowner’s/seller’s REA is the one that contacts me and orders the inspection so my homeowner/seller clients are already informed by the REA that they will be reviewing the report and attaching them to the seller’s disclosure.
