I flagged it as a "violation" (not that exact wording).
Client told me a contractor came and "further evaluated" the water heater and claimed it passes code.
I told him to get that in writing.
The only possibility I could think of is a loop hole in the code if the kitchen was not considered living area, but I always thought it was.
Any termination below an opening window is bad in my book regardless of location.
The only other thing I can think of is the contractor only examined the water heater inside and didn't go out to see where the flue terminated.
