Its not up to the property owner who gets to inspect for the potential buyer. What kind of world would that be, I would never get an inspection because I could not rely on its integrity.
It is up to the property owner who can traverse his property! Hard to do an inspection if you aren’t allowed on the property.
It’s up to the purchase and sale agreement. Either party can enter any (legal) stipulation they want, and as long as both parties agree…it is not up to us!
These inspector limitations are in the PSA. The buyer should have objected prior to signing. Just my 2 cents.
Unfortunately, that means the “Potential” Buyer must read and fully comprehend what it is they read in the PSA.
There was a time, (not too long ago), when informed Buyers would actually consult with a RE Lawyer prior to signing ANY Agreement!
I have two 30+yr real estate agents in my family. As buyer representatives they would have flushed this out early in the process. It’s not that complex, just read what your signing!
