Flue Clearance!?

I know on a standard roof-

3’ above roof
2’ above any part of building within 10’

This beauty is right next to wood rail (<2’) and not above roof of apartment wall which is also not 10’ away.
My questions are:

  1. what is actual required clearance to combustible outside? (such as railing)
  2. does anyone have knowledge or pic of how this should be done /extended above roofline of apartment?
    Appreciate any feedback!

How it is to be done/corrected is not as important for an inspector to report on as the fact that it needs to be corrected….if not 2’ above any part of building within 10’.

Agree- i will just write it up…
But i do like to educate myself- typically i see extended flues tied back higher up the roof. Just thinking how this may be secured.
Its a rental- and i personally don’t like the flue being within reach of someone on the porch.
Roof is shot- so if they do a re-roof- relocation would be best.
