A contractor purchased a home and lived there for some time repairing and upgrading the property. When it was time to sell, an inspection took place. The contractor asked the inspector to take it easy on the inspection as it would affect the sale. The inspector stated that this was a “snapshot in time” of the property, and we are happy to report the status as we observe it.

I studied the article about avoiding lawsuits. Knowing these should prove to be helpful to any inspector. It is also an article that can be referred to again and again before, during and after inspections. It has obvious experience from actual inspectors at its heart.

I learned from my article that when inspecting the attic space its a very good idea to carry a moisture meter that way if you suspect that there is a leak you can check the surrounding area . It’s also a smart move to have a very good flash light or head lamp for inspecting so you can look for the dark discolored areas , white or brown decay in the wood . Last I’m definitely will be purchasing a respirator for when I start doing inspections.

When reading about avoing lawsuits, it comes really clear to me to put on my thinking cap an think of every possible way to cover myself and my actions, keeping my safety and every others as well and document everything clear and fully as possible.

When inspecting the condition of a roof it is critical to do it accurately.If I were to be dishonest about the roofs condition I would be in violation of the code of ethics at Internachi and risk losing my membership with them.In addition to that the roof is very important to the overall health of a home.

It is very important to be able to fully back up what you claim as an inspector.For example it may not be a very good idea to claim that you check everything important in a home.The phrase everything important, is open to varying interpretations.

when the seller tells me to “go easy” he is telling me that the room its not at its best condition. my next step after his comment, is that i would inform him that my job is to make decisions that will follow the law no matter what but at the same time trying to please the seller as long as all the laws are follow.

I have learned, if you want to stay away from legal issues as much as possible, you don’t want to overstate your abilities, or let your vanity get in the way of your profession. To err is human, however, holding ourselves to the InterNachi code of ethics and a higher standard of practice, we can avoid as much as possible.

Being thorough is a must for a Certified Home Inspector. But let’s face it, we’re human and sooner or later a mistake will be made. Maybe we just had an off day. Maybe we “just knew” we had already looked at the stairwell. Or maybe we just got that phone call we’ve been dreading. Regardless of what that situation is, taking a few pre-cautions will greatly help in reducing the chances of a law-suit. Being a member and having the availabile resources of a national organization such as InterNACHI. Obtaining and using proper signage during your inspection. Taking plenty of pictures to document your inspection process. Always Always Always getting your pre-inspection agreement signed. These, along with other steps you can take, will greatly reduce your chances of a law suit when mistakes are made.

The roof was not inspected due to safety issues. Recommend that a certified contractor, perform a proper inspection for safety and damage. In addition, aerial photos would be also useful to determine the condition of the roof. Not inspected at this time.

Trusses cannot be altered in any way without the approval of a structural engineer. When you see plywood gussets added at truss connections like these triangular gussets, then an alteration of some sort has obviously been made and you have to recommend evaluation by a structural engineer. So, that condition went into the report

Trusses are designed to bear loads at very specific points. Typical roof trusses should not touch any interior walls and should bear only on the exterior walls. The two trusses at the left of the above photo are bearing on an offset portion of the garage wall.

A realtor has given you a client. The realtor informs you that they are very close to a critical sales mark to be top realtor. If they reach the sales dollar amount it will mean even more sales potential and clients. This could be the one to put me over the top, the realtor says excitedly. The realtor does not say anything more than this. Should the inspector conclude that the realtor is trying to indirectly get him to go easy on the inspection? Are there any nonverbal indications of this? Or is he realtor simply excited about his career opportunity and engaging in conversation? Is there anything the inspector could say that could remove any concern that the inspector has? Perhaps a comment like: I am happy that you have been so successful! I want to make sure that I do nothing that could cause a client to feel that a thorough inspection was not performed. That could come back and affect your reputation. More times than not you may hear a seller or their agent make the comment to the effect of “take it easy” on the inspection. Regardless of the situation, as a Certified Home Inspector with InterNACHI it would be unethical in many ways to “go easy” on any inspection. You are working for your client which is typically the buyer. I would simply respond to someone who made that type of comment in this way. “I’m here to inspect what I see. I will not risk my certification or career to “go easy” on certain conditions of the home nor will I go out of my way to exaggerate any issues.” As a Certified Home Inspector with InterNACHI we always have to remember to be professional and stay within the code of ethics laid out by InterNACHI. The code of ethics was established to protect us as inspectors as well as our clients. It is also what allows InterNACHI to be a trusted certification by many across the country. We can only inspect and report on what we see. If there is an issue with a property there is only one way to change that, fix it!

Asset protection is of utmost importance when owning your own business. Not only should you speak with an attorney when setting up your business you should also carry the proper insurance. Having an attorney help set up your business can protect your personal assets and make sure all the proper documentation on the business is in place to do so if ever involved in a lawsuit. The small fees insurance companies may charge to help protect your business is a second wall of defense. These premiums may seem high at the time but, when needed, are much cheaper than the possible consequence of not carrying insurance. Be sure all of your assets are protected before it is too late.

The inspector will do his or her job with pride and up to standards with InterNACHI practices and guidelines. The inspector will always be respectful to all parties he or she is communicating with as well.
