I’m directing this to Pennsylvania inspectors specifically. Checking to see how or where Pa. inspectors that do WDI inspections get the liability to satisfy the states requirement.


Pa. requires inspectors to carry $100K bodily injury and $ 100K property damage for pesticide applications even if you don't do pesticide applications.

All I do is the isnpection - no application but the state does not differentiate. Company I used in the past has decided not to write the coverage.

Any help appreciated.

of WDO. PA only licenses those who treat for WDO.


Of course if you want an applicators license you have to buy insurance even if you only inspect.

This is true however, a lot of lending associations will not accept a WDI Inspection Report (form NPMA-33) if the inspector does not include the (Company's Business Lic. No) on the report which you can only get of course by applying for the treatment license. It's a catch 22!

I too am looking for this coverage to perform the inspections!

(B) If the inspection reveals active infestation(s), Buyer, at Buyer?s expense, may within the Contingency Period, obtain a Proposal from a wood destroying pests pesticide applicator to treat the Property.
(C) If the inspection reveals damage from active or previous infestation(s), Buyer, at Buyer?s expense, may within the Contingency Period, obtain
a written report from a professional contractor, home inspector or structural engineer that is limited to structural damage to the Property caused
by wood-destroying organisms and a Proposal to repair and/or treat the Property.

Seems like the new clause requires the fox to guard the hen house. I was a REALTOR in PA for many years and I always recommended to my clients that they avoid applicators when choosing a WDO inspector, avoid mitigators when choosing a radon inspector, and avoid using their contractors to do the home inspection (back before regulation prohibited such conflict of interest).

Thanks for the responses but I’m still on square one. Joe Hagarty, are you licensed for inspections and applications? Do you use a surplus lines carrier to insure for the required Pa. liability and if so who are you using?

I am experiencing the same problem with regard to coverage.

Guys,


What I have done to get around all this is to sub out to a Company that

not only inspects for problems but treats for it also. As long as I am not

personally doing anything I don't have to worry about insurance. It works

for me.

Nick, do we have or can we exert any leverage on the Pa. Depaatment of Ag to look at this differently. As you said, is’t like having the fox guard the hen house. I’ve experienced cases where applicators do an inspection and come up with bogus reasons to charge for applications.

It is not likely that any assistance from Nick would persuade the PA Department of Agriculture to change any policy.

Obtaining the proper Insurance and Licensing is the only way to go.

I have made several contacts this week and have a few leads for next in an effort to duplicate what we already have.
