Nathan Thornberry sues Kevin O'Malley and related entities for Tortuous Interference

If I did not like iNACHI, it would seem so easy to just move on to something else. The last thing I would do would be to hang around like a sour grape. But for some, it’s like they get pulled into the twilight zone and cannot leave the message board. The vendor in question was dealt with a long time ago. Move on, get a life.

First of all tax exempt is a status, that does not mean whatsoever that the status of being Tax Exempt cannot be misused (Cheated). I believe that Nathan Thornberry is saying that you are defrauding (Cheating) the IRS, and the requirements of the Tax Exempt status.

That being said are you saying Nathan Thornberry is lying ? Yes or No ?

I suppose it could happen if we took down all our courses. Our tax exempt status is based on us continually providing our members with education. As long as we are doing that, we’re free to do anything else including marketing, events, product sales, business deals with for-profit companies, and any other lawful acts. I really don’t know what it would take to have the status revoked, but it would take a whole lot.

Perhaps he thought we were a charity, a 501©3. They are bound by totally different rules. We’re not. We’re a 501©6, like the NFL is.

Manny, yes that is correct, Nathan Thornberry did infract claim (on a public message board) that Nick Gromicko is cheating the Federal Government (IRS) in regards to NACHIs Tax Exempt status. Here is the thread For the 12 people that post on the InterNACHI forum...

Now don’t get me wrong having our discussions with Nick are fun, and enjoyable watch him dance and play with words and make himself look ridicules. BUT this claim in public by Nathan Thornberry about Nick cheating the IRS crosses too many lines. This is not just a heated discussion but more of a libelous, damaging and quite actionable in my opinion.

The point is that Nathan Thornberry posted:

“2. I am no longer on the InterNACHI forum, nor do I wish to be. I personally requested the deletion of all of my posts to ensure the InterNACHI forum would no longer benefit from my advice when Nick decided he would violate the IRS’ tax code and utilize his non-profit as a vehicle to benefit a private entity (ProLab). Are you really ok with him doing that?
Are you saying he is telling the truth or Lying?

And there’s the point. We had a special version of ESOP adjudicate this and make a recommendation. I had recused myself. The voting was heated. The recommended punishment was unanimous, and by the way, not permanent.

ESOPs recommendations were, for the very first time in its existence, over-ruled/ignored/ whatever by NACHI management.

It was only after a business matter between T-widget and ProLAbs erupted was he removed.

So, am I disappointed… not really. But, the stifling of open and honest debate and discussion over some of the pitfalls of dealing with this individual and, more specifically, some of the T’s and C’s of his arrangements is what is highlighted in this thread. So, now you see what Jim and I raised a red flag about so long ago.

Hey… all of you who receive something of value for nothing of value maybe you should finally ask a CPA or Tax Attorney about consideration and any possible implications it may have for you at tax time.

When I suggested recommending that our members do just that, the powers that be rebutted me, as did T-widget who threatened many with a lawsuit.

Since T-widget is likely seeing this and cam post it on his Kingdom’s electronic rag… I wish him the very best of luck in his many endeavors.

He is simply not worth any more time or effort.

I believed (and still do) that the vendor’s business practices with his own inspector customers, even if they are also InterNACHI members, isn’t anything I should involve myself with. Two parties should be free to voluntarily do business together if that is what they both want. His customers aren’t crying “foul.”

Having said that, I will concede that Joe Farsetta’s early assessments regarding this particular vendor were ultimately proven correct.

Personally, I miss Jim & Joe’s input here the most, we were better then.

I said the same thing in post #104, but now the vendor has been banned and it’s time to move on. Joe was right in some points, but the final call was in Nick’s hands. The truth found it’s way to the surface when it was all said and done. Now, let’s move on.

I think they were a real benefit to the forum, until they turned and wanted to do harm in their anger. I hope their anger heals.

FYI John on another note, I took your course 2 years ago, and I wanted to thank you again. It gave me a great intro into the IR world and since that time I have continued my studies nd also implemented IR into my inspections and it not only is a great help but has raised my bottom line $$

You do know that Lisa could not stand Nat from the very beginning, right. A person could tell by the disguse on her face when his name was mention. Too bad, Nick did not listen to anybody except himself on the Nat ordeal. Blind love does that to people.

Everbody knows, who saw what went down, that what Nick did to the Ethics Commitee was seriously wrong. I have a lot of respect for most that were on The Committee, especially Joe.
I have always accused Nick of being isulated on that mountain, and not knowning what was going on with the average inspector. It still holds true in the present.
It is not the freebies given away to members that makes an organization, it is how the organization sets examples of bettering the industry. Through setting these examples, these examples will rub off on members and make the organization strong. Until this happens, an organization is not an organization, but by name only.

I’m just kinda glad that he’s now ASHI’s problem, they really deserve each other. :smiley:
