Pre Inspection Agreement…

Hello, I’m new here and have a question I hope someone could help me with regarding InterNACHIs pre inspection agreement forms.

I am a new professional home inspector in Texas and am trying to get started with my business. I’m trying make or get a pre inspection report I can use with my customers. Texas has there own standards of practice inspectors must follow while performing inspections. My question is can I use InterNACHI’s PreIA or do I need to make my own? Does anyone from Texas here use InterNACHIs pre inspection agreement?

Have you tried going through your E&O provider? That is who provides mine.

Yes I did and they weren’t much help. Next year I’m going with a E&O who is more familiar with home inspections…

Who are you using now? I think there are only a handful of companies that will even write home inspection.

I’m using biberk and regret that quick decision… I was in a hurry because I had 2 months to show proof of E&O before my license application expired… I know what to do now after my Biberk contract expires.

Not sure if you are looking for a report or agreement but will address both.

We are required to use the promulgated inspection report form and SOP for any inspection that is for the purchase, sale, or consideration of sale or purchase of a residential property.

As for the pre-inspection agreement TREC asserts no control and no requirement for one. I don’t use INACHI’s agreement so do not know what is in it. However you can use any contract you want as long as you make sure the wording does not violate any of the Rules/Laws/SOP requirements. Since the Rules/Laws/SOP requirements at points can be convoluted I do recommend you have the agreement reviewed by another.

So get it reviewed by a lawyer no matter which pre inspection agreement I use?

Yes I would recommend that. First though go to your local chapter meeting and see if any there that are knowledgeable to review it as compared to the rules/laws/SOP and then have an Attorney review it. Other Chapter members may already have an Attorney they use who is very knowledgeable in Texas Inspection laws/rules/SOP and can save you the first step of another Inspector reviewing it.

What you will find out over time is the rules and SOP can be interpreted many ways by TREC. An Attorney not knowledgeable in “the game” will use a literal approach when reviewing your contract. That works well for general legal aspects but not “the game” aspects that are played by TREC if you are called on the carpet in front of them.
