Please accept this posting as a complaint against Mr. TJ Smith, InterNachi member and as an affiliate member and director of OACHI a chapter of InterNachi for unprofessional conduct in libelling a fellow member. And ignoring the bylaws he subscribed to as a member / director when he voted in favour of having Mr. Woods removed as a director without due process and contrary to the bylaws of OACHI.
His actions have brought distain on Mr. Kevin Woods and harm Mr. Woods reputation and business and standing amongst colleagues. Mr. Woods without the benefit of a hearing was alleged to have breached the bylaws. Mr. Smith who professes to have an understanding of the bylaws seems to be remiss in how the discipline committee of OACHI functions.
As VP of OACHI Mr. Smith acted unprofessionally and through his failure to answer questions about membership numbers he and his board present as accurate. Further Mr. Smith alleged that OAHI was in breach of its Act, but failed to provide any tangible proof other than his own opinion.
Again contrary to established guidelines of not actively promoting disdain for the other associations.
Since Mr. Woods was removed under the same provisions I strongly believe a double standard exists. Clearly Mr. Smith has no understanding of libel, nor has he proved I have harmed him financially, or otherwise.
2.4a Director Discipline (enacted May 9th, 2013)
Any Director proven to have made any statement of an unprofessional nature or proven to have made a personal opinion that could be related back to OntarioACHI, without first getting full board approval to have that opinion representative of the Association is required to resign their position as Director immediately.
Further as stated in the bylaws of OACHI
4.1 Discipline of Members
The board shall have authority to suspend or expel any member from the Corporation for any one or more of the following grounds:
violating any provision of the articles, by-laws, or written policies of the Corporation;
carrying out any conduct which may be detrimental to the Corporation as determined by the board in its sole discretion;
for any other reason that the board in its sole and absolute discretion considers to be reasonable, having regard to the purpose of the Corporation.
In the event that the board determines that a member should be expelled or suspended from membership in the Corporation, the president, or such other officer as may be designated by the board, shall provide twenty (20) days notice of suspension or expulsion to the member and shall provide reasons for the proposed suspension or expulsion. The member may make written submissions to the president, or such other officer as may be designated by the board, in response to the notice received within such twenty (20) day period. In the event that no written submissions are received by the president, the president, or such other officer as may be designated by the board, may proceed to notify the member that the member is suspended or expelled from membership in the Corporation. If written submissions are received in accordance with this section, the board will consider such submissions in arriving at a final decision and shall notify the member concerning such final decision within a further twenty (20) days from the date of receipt of the submissions. The board’s decision shall be final and binding on the member, without any further right of appeal.

I agree Stephen.
But,
Apparently Nick likes to let the “bad boys” hang around and stir up crap. He recently let Joe Tedesco back. And of course his favorite vendor is here day and night.
