Understanding the Pennsylvania Home inspection law

I tryed to post this to Misc. Discussion however I do not have permission

I am having a hard time understanding the Pennsylvania Home inspection law, ACT 114. I am mostly concerned about the following provisions:

The Act contains a provision of an agreement of transfer regarding the right of the buyer to obtain a home inspection report and providing for the consequences, if any, shall provide that the home inspection be performed by a full member in good standing of a national home inspection association in accordance with the ethical standards and code of conduct or practice of that association. A home inspection performed by a person who has not attained full membership in a national home inspection association satisfies the requirements if the person is supervised by a full member in good standing of a national home inspection association who agrees to be responsible for the home inspection report by signing the report.

What types of inspections can a working member do, and what kind of inspections can they not do. As apposed to a full member? I was also reading somewhere in the law that a working member needs to have the report signed off by a full member.

Please help as I am trying to work out all that I need to do to be compliant with the law.

Thank You for your time in responding. So from the interpretation of the law (to my understanding) I would have to have a supervisor sign off on my first 100 inspections, this would kind of make it difficult to start off as a sole proprietorship (LLC) without knowing someone in the field who would have to take considerable time looking over all of my first 100 reports !? How does someone go about starting off on the right foot?

I am in the same position as you. I am starting a new inspection business and I am determined to do it the right way and the legal way. I have three certified inspectors lined up. Two in PA and one in NY. All about a 100+ mile drive one way. They have agreed to let me tag along, but things are slow now and they often forget about me. I have 13 inspections toward my first 100. I did find more who were willing to help out, but they wanted me to either enroll in their training program (very expensive) or pay at least $50 per inspection. (That was $50 for a ride-along, and $75 if I wanted to ask questions…nice) I’m passing the time by working on other certifications, ie; Radon, termites, septic and doing small “handyman” type jobs. I suggest that you join an organization (you’ll need to anyway to operate in PA) and seek help from their membership.
