Dear Committee:

Could you please provide the relevant sections of the Web Policy of which I am in breach of please? There is nothing in the policy restricting the right of members from re-posting on any other discussion board those of which are posted on the CAFE. As a matter of fact in the Web Policy it states succinctly OAHI cannot guarantee the posts will be secure or not forwarded, et ceteras. It does not state in the rules that such activity is restricted or that one can be suspended for same. Nor does it appear I am in breach of the other relevant sections of the Web Policy. Further, please explain what section(s) of the OAHI bylaw or PR158 have been violated so that I might properly react to this seemingly unilateral decision made without any input whatsoever from me.

Can you tell me who serves on the Forum Committee please?

Could you please provide me with a copy of the posts in questions please? Have other posters in this matter on the CAFE been similarly suspended?

Can you please tell me how a 90 day suspension was decided on given that there is nothing in the by-laws permitting suspension, nor empowering anyone but the DPPC to enact discipline as per the by-laws?

Why is there no email contact addressfor Ms. Lalich considering she is an employee and forum administrator? This is most unusual for a discussion forum not to have a contact on the forum board.

Can you please explain to me why my Constitutional rights have been infringed on? After all OAHI is legislated under the provincial government as a self regulating body as per PR 158.

If the Forum committee can not substantiate its claims and what appears to be a lack of due process and impartiality in this matter and apprehension of bias, I request that my access to the CAFE be immediately reinstated.

Raymond, CAHPI would not let me take the National Certification exam and returned my money .
I would like to donate the $107:00 to you to use if you need to get a lawyer to stop OAHI and CAHPI treating all Canadian Home Inspectors so bad .
We have lost many Great Home Inspectors and are loosing many who wish to become Home inspectors with the lousy and unfair treatment they are put through .

Ray for your information Dave Bottoms said about you posting on the NACHI site .
Dave Bottoms has posted your letter on the OAHI CAFE . He says don't do it and he does it .
Dave Bottoms is the guy who does not follow the OAHI rules
( you can only be an associate for 3 years )
( Eight years and he still has not done the 150 inspections to get his RHI )
( I guess he is just a slow learner ).
Glad you are around Dave we all love you and know you need all the help you can get .

constrution company have not heard much lately on it .

Gee thats strange it would seem as evidenced by this latest posting that OAHI had no intention whatsoever of dealing with this fairly. Clearly by the latest posts the OAHI Forum Committee fair and equal justice rests on who you are not what you say. Clearly reasonable apprehension of bias, negligence to enact the rules equally, suspending and infringing Charter rights over those of others, and failure to show just cause. What is more amusing is that Mr. Bottoms clearly shows who is running the show in the asylum.

This is not the first time OAHI has been in contempt of its own authority and the by-laws it has promised to abide by when PR 158 was enacted. There are many members who have had arbitrary fines imposed and membership upgrades witheld all without any form of hearing. How is anyone who becomes Nationally Certified ever going to know for sure that they will be treated equally?

Do you really trust this self regulating body to effectively oversee its jurisdictional duties as a signatory to CAHPI?

Dear Committee:

I see that equality is absent from decisions being made and there is the appearance that the Committee has acted with reasonable apprehension of bias. It is also readily apparent that the Committee is able to act with impunity and to manipulate the rules at their discretion, contrary to the rules and to due process as stated in the by-laws.

As you can see below I have been suspended while Mr. Bottoms apparently is still able to post. Under the circumstances it appears Mr. Bottoms posts are approved and endorsed by the Forum Committee and Ms. Lalich. It also appears the Forum Committee has no intention of meeting out its rules in a fair and equal manner.

I also have concerns that these emails are not being responded to or acted on because of the obvious indifference's and the make up of the Forum Committee. It is reassuring to see a self regulating body acting outside of its policies and mandate as afforded under the by-laws and enacting legislation.

I understand our NACHI colleague Marcel Gratton has been putting up good arguements on the CANUCK list against the likes of George Webb and Dave Bottoms, both of who have been calling NACHI members liars and reprobates. Mr. Webb even went so far with his disdain that he made some derogatory comments about Marcels parents.

These OAHI members are a nice lot aren't they?

Marcel we all know whats going on and I thank you for trying to deal factually with these hypocrites.

Just remember the CANUCK list is like Swiss Cheese, its full of holes. I wish to thank Mr. Bottoms et al for continually pointing people to the Nachi website.

This also for the benefit of NACHI members who may also be Students, Applicants or Associates or RHI's who have been fined without due process.

Make no mistake about this link will dispell and any concerns about how the system is suppose to work in OAHI. This document is directly from the OAHI Association lawyer. It is as current today as it was back in March of 2001.

You can see for yourselves that the Associatioin lawyer was very succint in how OAHI is to carry out its disciplinary mandate. I have proof that this is not the case and members rights are being abused by the DPPC and the President, Secretary of OAHI and other Directors who are negligent in their oversite.

What is even more of a concern is the fact OAHI is a signatory to CAHPI and National Certification. Having stated this this raises grave concerns about a fair and impartial system and that CAHPI cannot rely on nor trust its major signatory to National Certification to carry out with honesty, or a standard of care the review process. It is readily apparent OAHI is willing to step well outside the confines of due process, diligence and legality in order to prosecute Nachi members who are also OAHI members.

What does this mean. It means if any member of OAHI has been threatened with a fine, delay in membership upgrade, or finded while being a practicing member of NACHI you are not obligated to pay the fine. Any such fines collected under this abuse of power are null and void. These monies collected are subject to return and if not you are entitled to seek redress in Small Claims Court.

I would like to know what Claude Lawrenson has to say on this matter given that he is the National Ethics Chair of CAHPI which is overseeing Certification and Test Inspection Peer Review. These practices by OAHI are documented and frankly I am ashamed that CAHPI is turning a blind eye to such flagarant abuses, and discrimination.

Having seen how a good DPPC was run OAHI is far from as efficient it was before .

I would like to know why Mr. David Faux Secretary of OAHI is signing his names to letters on behalf of OAHI knowing them to contravene the by-laws and due process as afforded and stated as per the OAHI Association lawyer at link?

**Mr. Faux beyond breaching the by-laws which he undertook to uphold when he submitted and was elected to the Board of Directors of OAHI. Mr. Faux and cohorts feel it is well within their power to negligently abuse due process.

Also it is apparent they are willing to state on paper that they have complaints which have justified their actions yet they are unable to provide proof of a legitimate complaint. Nor is he interested in allowing the people the right to explain their side. Just pay the fine! They also have no concern or issues telling members of OAHI they cannot inspect while being a student member.

I also understand the Mr. Faux is also the CAFE Forum Committee Chair. I also see that he is negligent and ignorant not only with proper procedure and due process he has no problem exacting the same standards and penalities on the OAHI CAFE Forum. Thus far Mr. Faux is unable to explain his actions nor able to provide proof that he is acting within the confines of his office or that of the by-laws.

Is Mr. Gerretson Minister (MPP) of Municipal Affairs and Housing aware of these grave concerns?
Is the Minister of Consumer and Business Services aware of these infringements of a private members bill PR 158?
Is CMHC aware of these abuses of power and due process vis-a-vis the National? Apparently not!

For the record this is not by any means the first example of abuse. There are other documented cases which I am privy to.

Like I said there are two rules in OAHI and they permit blatant and wanton disregard for the by-laws. All backed up by a member who can't for the life of him move past Associate Member which he has held for 8 long years! The same person who utters threats. The same person who tells everyone else how to conduct their affairs but can't manage to do it himself. Nice.

He must be infatuated with NACHI he keeps posting the link.

Thanks Kieth this unfortunately is for real . We have many OAHI/ NACHI members who are being discriminated big time by OAHI.
I am sorry to say if it is not handled properly and very soon this could be the end of NACHI in Canada.
I and others see not much future in belonging to any association.
This breaks my heart to see how great inspectors have gone to Home DE-PO back to installing eaves troughs ,Roof or factory work .
They have fought long and hard and there comes a time when many will just give up .
I have just received three letters of complete disappointment in the HI industry in Canada..
I will hang in but know of around 10± who are ready to give up immediately

Kieth thanks for the support. Its remarkable how many people are willing to tolerate improprieties, but what is even worse is people not speaking up in support of correcting the improprieties; that is until they are fetted out and its there turn to sample the persecution.

Thanks for the support. I bet after you read through this it brings back memories of how poorly treated you were in OAHI.

To phrase verbatim from one of the letters sent out by Mr. Faux he states in closing, "As a result of your being in violation of the OAHI By-laws, you have put the Association in a compromising situation with CAHPI, our national body."

Well isn't that line a hum dinger! Here Mr. Faux is admonishing the Nachi member for his alleged infringement as a Oahi member and is unwilling to provide any proof of his allegations and is acting outside his capacity, contrary to the by-laws and he is worried about a compromising situation with the national body? What planet is he on?

I guess Mr. Lawrenson as Ethics Chair is not concerned about compromising situations when it comes to due process and natural justice by a provincial self regulating body that is a signatory to CAHPI. Just who is in the compromising situation? Well it appears to be OAHI.

Who in their right mind would join an organization that treated it's membership with such unforgiveable disregaurd? The persons at OAHI who are responsible for this unbelievable travisty clearly have thier heads in a dark and unsanitary place. They have done thier faultering organization more harm in one week than all the "dangerous" non members have in years.

If anyone wants a clear illustration of how OAHI works, how members are treated like that material found in the solids tank, and how it is all about collecting fees and not helping members this is it.

Want more reasons not to join OAHI and it's anal retentive old men? Stick around these guys will provide them.
