Hello everybody, I’m just starting my business and have a question about the internachi pre inspection agreement. Has any one made changes to it? If so what? Also the liability clause seems to have disappeared and has been replaced with a warranty clause? Is that because of the Nathan thornburry warranty service? Any help would be greatly appreciated thank you!
IMO, every single legal form and document you intend to use in your business, regardless of where it originates from, should be reviewed and adjusted by your Attorney for your use in your local City/County/State. My original (Inter)Nachi drafted PIA looks nothing like it does today, and very rarely does anybody, lawyers included, question the validity of it.
Are you referring to this new, recently updated, agreement for California?

I agree, but the frustrating thing is that go to three different attorneys and you will end up with three different agreements. And then in court, one judge will say your agreement is solid and another judge will basically toss it.
I’ve never been sued or in court with mine, but one attorney (reportedly) told an unhappy client that my agreement was unbreakable, but when I had an attorney review it, he tossed out most of it and rewrote it. I hated his rewrite and ended up making some edits to my existing agreement. I have never had an attorney client comment negatively on my agreement, but only one kinda read it, which probably says more about the viability and enforceability of an agreement than anything else does.
