GFCI answers are tricky as they are
always changing.
My answers are based on 2002 and carry over to 2005 NEC.
All outlets that serve dwelling unit kitchen counter tops must be GFCI protected regardless of the sink location.
To find what outlets are considered 'serving' the counter top you can look at 2002 - 210.52(C)(5) which first says
Quote:
Receptacle outlets shall be located above, but not more than 500 mm (20 in.) above, the countertop. ........
But then there is the exception which says
Quote:
receptacle outlets shall be permitted to be mounted not more than 300 mm (12 in.) below the countertop.

I appreciate the info, but this still bothers me some how.
The outlet on the opposite side of the pony wall is in closer proximity to the sink than the outlet on the other side of the room 6 ft away from the sink.
Would you not write it up at all or would you mention it as a possible safety issue?
