New Cellphone Law Coming to Colorado

The law went into effect here in Ohio October 2023 and gave, I think it was a year of warnings, but not anymore, you get caught, you get a ticket.

Penalties

  • 1st offense in two years: 2 points assessed to driver’s license, up to a $150 fine**.***
  • 2nd offense in two years: 3 points assessed to license, up to a $250 fine.
  • 3rd or more offense in two years: 4 points assessed to license, up to a $500 fine, possible 90-day suspension of driver license.
  • Fines doubled if the violation occurs in a work zone.

I still see people talking or texting while driving, but at least around here it seems much less so than before they started enforcing the law.

And this law is a no brainer. Studies have shown that holding a cellphone while driving is distracting and dangerous when compared to not using one. Hands free use is also distracting but less dangerous.

Now if someone falls into the camp of those who don’t believe in studies or facts then you can ignore this post. :blush:

I remember many days of driving down the highway wondering which was worse, drunk driving or driving while using the phone? It got really bad.

Yup, it is especially obvious when someone is doing 40 MPH in the left lane of the highway and the car is constantly crossing the white lines.

The thing I noticed in Oregon when the law went into effect is that people hold their phones and talk into them (presumably in speaker mode) rather than up to their ear. I’ve never understood if they think that is supposed to be allowed? (it’s not) In practice, it’s much more obvious and easy for the police to spot.

Hawaii has a similar law and it both places I’ve seen police on motorcycles roll through the lanes and stoplights and catch people… it usually doesn’t take them long to find an offender. I think it’s kind of BS that you can’t even touch your phone when stopped.

You responded specifically to a post comparing drunk driving to texting while driving. Which you quoted. Only obvious to you.

Okay fair point. Just so it’s clear I was referring to a person using a cellphone while driving which I’ve encountered almost daily during my commute to and from work.

Agree, but as with most laws, will they be enforced. Around here the police are shorthanded and with the uptick with major crimes they are busy dealing with those types of crimes. The police here anyways don’t come to an accident unless it’s more than a fender bender.
So it is of my opinion that one should be the best defensive driver you can be out there.

Yea, stupid law that is already covered in the “Impeded Operation” law, which already gives cops the right to pull you over. Hanging crap off your mirror falls under the same law.

Messing with your phone when it’s stuck to your dashboard or cupholder is worse than having it in your hand. If you cross the line, or don’t move on a green light, is when you are impeded.

Most traffic laws are enacted for two reasons, in my opinion.

  1. An excuse to pull you over and start an investigation.
  2. Collect taxes.

Reminds me of the story. A town had one traffic light and 3 police officers. The town was having difficulty funding the police. So they took out the traffic light, which made the police obsolete- so they disbanded the police.

What town only needs the police for traffic. With no stop sign you would think they’d have a lot more speeding. That story doesn’t have a ring of truth.

Mine is laying on the charger and it’s linked to both my Honda and my Ford via android Auto.

I just hit the green answer button on the dash/steering wheel and speak. shrug.

I can call out from the Dash by hitting the listen button, speaking a “call wife” and it dials. Again, I don’t have to touch the phone at all. I don’t call out much though, but my phone rings regularly when driving. My issue is that I get to where I’m going, I’ve made 3 promises to three different people and got to add it to my calendar. I’m ready for AI to do all that for me.
