How will this bill, if signed, effect a new inspector that has yet to start his business? I’m an engineer planning to transition into the Home Inspection industry. I couldn’t afford to “apprentice” with another inspector. I read the bill, all 14 pages. As I understand, when I pass the exam & complete the training I will have 3 years to get the 250 inspections required for licensure? Is that what you mean by “plenty of time to meet the requirement”?

How exactly does one accomplish this? I'm a 40 year old guy with a family, it's not like I can just go out and do inspections for my future competition at minimal compensation or pay them to babysit me for over a year. Wouldn't be a problem if I was 20 something and single but those days are long gone.

I think I found my answer at the very end, after the discipline stuff and requirements for being appointed to the board. I didn’t really look too close at these items because hopefully the discipline won’t be an issue for me and being on the board isn’t a current proiority.

A BILL
To enact sections 4768.01 to 4768.13 and 4768.99 of the Revised Code to create the State Board of Home Inspectors, to require the licensure of home inspectors, and to regulate the licensure and performance of home inspectors.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That sections 4768.01, 4768.02, 4768.03, 4768.04, 4768.05, 4768.06, 4768.07, 4768.08, 4768.09, 4768.10, 4768.11, 4768.12, 4768.13, and 4768.99 of the Revised Code be enacted to read as follows:
Sec. 4768.01. As used in this chapter:
(A) "Client" means a person who retains for compensation the services of a person to conduct a home inspection.
(B) "Home inspection" means an examination of the readily accessible components of a residential building for a client that includes all or substantially all of the following: heating system, cooling system, plumbing system, electrical system, structural components, foundation, roof, exterior and interior components, and any other related residential housing component the state board of home inspectors specifies in rules. "Home inspection" includes inspections that are limited to visual inspections. "Home inspection" does not include environmental testing or determination of compliance with applicable statutes, rules, resolutions, or ordinances, including, without limitation, building, zoning, or historic codes.
(C) "Residential building" means any part of a structure that is occupied or intended to be occupied as a residence.
Sec. 4768.02. (A) No person shall conduct a home inspection or represent a qualification to conduct a home inspection for compensation unless that person is licensed as a home inspector pursuant to this chapter, is licensed as an associate home inspector pursuant to this chapter and performs inspections under the supervision of a licensed home inspector, or is registered as an associate home inspector pursuant to this chapter and performs home inspections under the supervision of a licensed home inspector.
(B) No person shall perform a home inspection unless it is performed pursuant to a written contract.
Sec. 4768.03. (A) There is hereby created the state board of home inspectors in the department of commerce. The board shall consist of five members appointed by the governor with the advice and consent of the senate. All members shall be residents of this state. At the time of appointment, a member shall have performed not fewer than five hundred home inspections for compensation and shall have been a licensed home inspector in this state for at least five years.
(B)(1) Of the initial appointments, two shall be for terms of four years, two shall be for terms of three years, and one shall be for a term of two years. Thereafter, each term shall be for four years, ending on the same day of the same month as the term that it succeeds.
(2) Each member shall hold office from the date of appointment until the end of the term for which appointed. Vacancies shall be filled in the manner provided for original appointments. A member appointed to fill a vacancy prior to the expiration of a term shall hold office for the remainder of that term. A member shall continue in office subsequent to the expiration of the term until a successor takes office. Members may be reappointed, except that no member shall serve more than two successive terms in addition to any unexpired term to which the member was appointed.
(3) A member may be removed for misfeasance, nonfeasance, or malfeasance in office. A vacancy on the board does not impair the right of the other members to exercise all of the board's powers and duties.
(C) Each member of the board shall receive compensation in an amount fixed pursuant to division (J) of section 124.15 of the Revised Code for each day employed in the discharge of official duties, as well as actual and necessary expenses incurred in the performance of those duties.
(D) The board annually shall elect one member to serve as chairperson and one member to serve as vice-chairperson. The board may appoint one person, who need not be a member of the board, to serve as secretary.
(E)(1) The board shall meet at least four times per year and, at the direction of the chairperson or at the request of three board members, may hold additional meetings as necessary to discharge its duties. The chairperson shall determine the location, date, and time of all meetings. Meetings may be held by electronic means, including telephone conference and computer conferencing applications, provided that all members have access to the electronic means of the meeting and access to all communications pertaining to the subject of the meeting.
(2) The chairperson shall provide each member with written notice of the location, date, and time of each meeting not fewer than ten days prior to the scheduled date of the meeting, except that a meeting may be held with less notice when necessary to conduct the board's business properly. A majority of the members of the board constitutes a quorum, which is necessary to transact and vote on any matter before the board.
Sec. 4768.04. The board of home inspectors shall do all of the following:
(A) Employ staff;
(B) Adopt rules in accordance with Chapter 119. of the Revised Code to carry out the purposes of this chapter, including rules that do all of the following:
(1) Specify any residential housing component not described in the definition of "home inspection" that the board determines should be visually examined during a home inspection;
(2) Establish standards of practice to be followed by persons licensed or registered under this chapter. The standards shall specify items an inspector shall visually examine with respect to each component included in a home inspection. The standards shall be no less stringent than standards of practice adopted by nationally recognized associations for home inspectors that the board recognizes.
(3) Establish a code of ethics for persons licensed and registered under this chapter. The code shall specify guidelines for acting honestly and in good faith toward a client and avoiding conflicts of interest.
(4) Establish standards to govern disciplinary proceedings the board conducts and the reinstatement of licenses the board suspends pursuant to those proceedings;
(5) Establish the amount of any fees this chapter requires. The rules shall specify that for the time period beginning on the effective date of this section and ending three years after that date, license fees shall not exceed five hundred dollars per year per licensee. Thereafter, the amount of any fee shall be sufficient to defray necessary expenses incurred in the administration of this chapter and the rules adopted under it.
(6) Establish the information to be provided on an application for licensure and registration under this chapter;
(7) Establish procedures for processing, approving, and denying applications for licensure and registration under this chapter;

The course of study shall consist of not fewer than one hundred twenty hours of training, including training in the classroom and training that involves observation of home inspections.
(9) Establish requirements and standards for the continuing education of home inspectors in accordance with section 4768.07 of the Revised Code;
(10) Establish provisions governing the registration of persons working towards satisfying the requirements for licensure as an associate home inspector;
(11) Establish requirements governing the supervision of persons performing home inspections as registered or licensed associate home inspectors;
(12) Establish procedures and requirements for reciprocity of a person licensed or certified in another state;
(13) Establish any other provision necessary for the administration of this chapter and rules adopted under it.
(C) Approve an examination for licensure that is accepted by a national association of home inspectors or national associations of home inspectors the board recognizes;
(D) Issue a home inspector license, an associate home inspector license, a license renewal, or a registration as an associate home inspector to any person who satisfies the requirements this chapter establishes. The board shall register or issue a license only to an individual and shall not register or issue a license to a corporation, limited liability company, partnership, or association, although a licensee may sign an inspection report in a representative capacity on behalf of those entities.
(E) Retain all licensure and registration application materials submitted to it and maintain a register of the names and addresses of all individuals to whom the board has issued a license, renewed a license, or issued or renewed a registration.
Sec. 4768.05. (A) To obtain a license to practice as a home inspector or an associate home inspector, an individual shall submit an application to the state board of home inspectors on a form the board provides, together with the fee the board prescribes, and satisfy the requirements set forth in this section. The application shall include all of the following:
(1) A pledge the applicant signs, agreeing to comply with the standards of practice and code of ethics the board establishes;
(2) A statement that the applicant understands the grounds for any disciplinary action that may be initiated under this chapter;
(3) Proof of a general liability insurance policy in an amount of one hundred thousand dollars or such higher minimum amount the board specifies;
(4) Upon the request of the board, a sample of the home inspection reports the applicant has prepared in the course of the applicant's practice as an associate home inspector;
(5) Any other information the board requires by rule.
(B) An applicant for licensure as a home inspector shall satisfy all of the following requirements in addition to the requirements set forth in division (A) of this section:
(1) Have had a license as an associate home inspector for not less than one year and performed not fewer than two hundred home inspections for compensation under the supervision of a licensed home inspector;
(2) Successfully completed high school or its equivalent;
(3) Pass an examination the board offers or prescribes or an examination the board approves that is offered by a nationally recognized association of home inspectors that the board recognizes.
(C) An applicant for licensure as an associate home inspector shall satisfy all of the following requirements in addition to the requirements set forth in division (A) of this section:
(1) Have served as a registered associate home inspector for at least twelve months;
(2) Successfully completed high school or its equivalent;
(3) Successfully completed a curriculum the board approves consisting of not less than one hundred twenty hours with at least eighty of those hours devoted to classroom hours;
(4) Performed not fewer than thirty home inspections as a registered associate home inspector under the direct supervision of a licensed home inspector;
(5) Passed an examination the board offers or prescribes or an examination the board approves that is offered by a nationally recognized association of home inspectors that the board recognizes.
(D)(1) An applicant for registration as an associate home inspector shall file an application for registration with the board on the form the board provides, together with the fee the board specifies and proof of a general liability insurance policy in an amount of one hundred thousand dollars or such higher minimum amount the board specifies. The applicant shall provide a signed statement of intent to perform at least thirty home inspections and a statement signed by the applicant and a licensed home inspector agreeing that the applicant will perform home inspections under the supervision of the licensed home inspector.
(2) Registration as an associate home inspector is effective for twelve months after the date of registration and may be renewed for an additional twelve-month period if the registrant is unable, for good cause, to complete thirty home inspections during the initial twelve-month period.
(3) A registrant, upon the board's request, shall furnish a sample of the inspection reports prepared in the course of the registrant's practice.
Sec. 4768.06. (A) Any license issued pursuant to this chapter expires two years after the date of issue and every two years thereafter.
(B)(1) To renew a license, a licensee shall file a renewal application with the board of home inspectors pursuant to the procedures set forth in Chapter 4745. of the Revised Code, along with proof of satisfying the continuing education requirements the board establishes by rule.
(2) A licensee who fails to renew a license before its expiration may, during the six months following the expiration, renew the license by following the procedures in division (B)(1) of this section and paying a late fee in an amount the board establishes by rule. A licensee who applies for a late renewal pursuant to this division may engage in all activities the license being renewed permits until three months after the license expires.
(3) A licensee who fails to renew a license prior to its expiration or during the six months following its expiration may obtain a license by complying with the application procedures and meeting the requirements for a license set forth in division (B) or (C) of section 4768.05 of the Revised Code.
(C) The board shall not renew any license if the licensee fails to submit proof of satisfying the continuing education requirements. A licensee who fails to submit the required proof may obtain a license by following the application procedures and meeting the requirements set forth in section 4768.05 of the Revised Code.
Sec. 4768.07. (A) During each two year period during which a license is valid, a licensee shall successfully complete the continuing education requirements the state board of home inspectors establishes by rule, to include not less than twenty and not more than forty hours of continuing education instruction in courses or seminars the board offers or approves.
(B) No amendment or rescission of a rule involving continuing education requirements shall operate to deprive a licensee of credit toward renewal of licensure for any course of instruction the licensee completes prior to the effective date of that amendment or rescission.
Sec. 4768.08. The state board of home inspectors shall investigate complaints, on the board's own motion or on receipt of a complaint, concerning any alleged violation of this chapter or rules adopted under it. The board may employ investigators and auditors to assist in investigating complaints and conducting investigations, audits, and other inquiries that the board considers appropriate to enforce this chapter and rules adopted under it.
Sec. 4768.09. (A) If, upon examining the results of an investigation, the state board of home inspectors determines that reasonable and substantial evidence exists that a person licensed or registered pursuant to this chapter has violated this chapter or rules adopted under it or otherwise has committed misconduct for which disciplinary proceedings may be initiated as specified in divisions (A) to (G) of section 4768.10 of the Revised Code, the board shall notify the licensee or registrant not later than five business days following the determination. The licensee or registrant may request a hearing pursuant to Chapter 119. of the Revised Code. Hearings shall be conducted by hearing officers the board retains.
(B) If a hearing is conducted, the hearing officer shall determine whether evidence of a violation exists, notify the complainant and the licensee or registrant of that determination not later than five days after it is made, and describe the basis for the determination. Within fifteen business days after the hearing officer notifies the complainant and licensee or registrant, the complainant or licensee or registrant may file a request that the board review the determination.
(C) If a request for a review by the board is filed, the board shall review the hearing officer's determination at its next regularly scheduled meeting. The board may hear the testimony of the complainant or licensee or registrant at the meeting on request of either party. The board either shall affirm or reverse the decision of the hearing officer and notify the complainant and licensee or registrant of its decision within five business days after making its decision.
(D) If the board determines that a licensee or registrant has violated this chapter or rules adopted under it, after review of the hearing officer's report and evidence, the board shall order the disciplinary action the board considers appropriate, which may include any one or more of the following:
(1) A reprimand;
(2) Suspension of the license or registration for a specific period of time;
(3) Suspension of the license or registration until the licensee or registrant complies with conditions the board establishes;
(4) Revocation of the license or registration.
The decision and order of the board is final, subject to review in the manner provided in Chapter 119. of the Revised Code and appeal to any court of common pleas.
Sec. 4768.10. The state board of home inspectors may refuse to issue or renew a license or registration if an applicant for a license or registration or license or registration renewal has done any of the following:
(A) Accepted compensation from more than one interested party for the same service without the written consent of all interested parties;
(B) Accepted commissions or allowances, directly or indirectly, from other parties dealing with a client in connection with the home inspection for which the licensee or registrant is responsible, without the express written approval of the client or the client's representative. This division does not apply to inspections subcontractors provide, including, without limitation, pest or environmental inspections.
(C) Failed to disclose promptly to a client written information about any business interest of the licensee or registrant that may affect the client in connection with the home inspection;
(D) Plead guilty to or been convicted in a court of competent jurisdiction of forgery, embezzlement, obtaining money under false pretenses, larceny, extortion, conspiracy to defraud, theft, or any crime of moral turpitude;
(E) Failed to supervise adequately and in accordance with rules a registered or licensed associate home inspector performing home inspections under the supervision of the licensed home inspector;
(F) Violated a standard of practice or provision of the code of ethics established in rules;
(G) Failure to maintain insurance or proof of financial responsibility as this chapter requires.
Sec. 4768.11. The state board of home inspectors may apply to any court of common pleas to enjoin a violation of this chapter or rules adopted under it. Upon a showing by the board that a person has violated or is violating this chapter or rules adopted under it, the court shall grant an injunction, restraining order, or other appropriate relief.
Sec. 4768.12. The state board of home inspectors shall deposit all money collected under this chapter in the state treasury to the credit of the home inspectors fund, which is hereby created. Money credited to the fund shall be used solely to pay costs associated with the administration of this chapter and rules adopted under it.
Sec. 4768.13. Every partnership, corporation, limited liability company, or association that employs or retains the services of a person registered or licensed under this chapter, whether as an independent contractor or under the supervision or control of the partnership, corporation, limited liability company, or association, is jointly and severally liable for any damages incurred by that person as a result of an act or omission concerning a home inspection report prepared while employed or retained by the partnership, corporation, limited liability company, or association.
Sec. 4768.99. Whoever violates division (A) of section 4768.02 of the Revised Code is guilty of a misdemeanor of the third degree on a first offense and a misdemeanor of the first degree on each subsequent offense.
Section 2. Section 4768.02 of the Revised Code takes effect four hundred eighty days after the effective date of this act.
Section 3. (A) Not later than thirty days after the effective date of this act, the Governor, with the advice and consent of the Senate, shall make appointments to the State Board of Home Inspectors.
(B) Not later than one hundred eighty days after the appointment of all initial members to the State Board of Home Inspectors, the Board shall adopt the rules this act requires.
(C) Members appointed to the State Board of Home Inspectors during the time period beginning on the effective date of this act and ending seven years after that date shall meet the following membership requirements instead of the membership requirements described in section 4768.03 of the Revised Code:
(1) Is a resident of this state;
(2) Has performed not fewer than five hundred home inspections for compensation.
Section 4. Notwithstanding section 4768.05 of the Revised Code, and except as provided under section 4768.10 of the Revised Code:
(A) During the period of time beginning on the effective date of this act and ending three years after that date, the State Board of Home Inspectors shall license an individual as a home inspector if the individual applies to the Board for a license on a form the Board provides and pays the fee the Board prescribes in rule, if the applicant demonstrates all of the following to the Board's satisfaction:
(1) The applicant has passed a nationally accredited home inspection examination or completed an educational program in home inspection certified by the Board;
(2) Prior to applying for licensure, the applicant performed not less than two hundred fifty home inspections for compensation;
(3) The applicant has a general liability insurance policy in a minimum amount of one hundred thousand dollars or such other higher minimum amount the Board specifies by rule.
(B) During the period of time beginning on the effective date of this act and ending three years after that date, the State Board of Home Inspectors shall issue a provisional home inspector license to an individual if the individual applies to the Board for a provisional license on a form the Board provides and pays the fee the Board prescribes by rule, if the applicant demonstrates all of the following to the Board's satisfaction:
(1) The applicant has passed a nationally accredited home inspection examination the Board recognizes or completes an education program in home inspection the Board recognizes.
(2) Prior to applying for provisional licensure, the applicant performed not fewer than one hundred home inspections for compensation;
(3) The applicant has a general liability insurance policy in the amount of one hundred thousand dollars or such other minimum higher amount the Board specifies pursuant to rule.
(C) During the three years after the date that is two hundred seventy days after the effective date of this act, the Board shall issue a home inspector license to any holder of a provisional license who applies to the Board on a form the Board provides, pays the fee the Board prescribes by rule, and demonstrates all of the following to the Board's satisfaction:
(1) The applicant complies with the continuing education requirements established under section 4768.07 of the Revised Code;
(2) The applicant has completed at least two hundred fifty home inspections for compensation after receiving the provisional license;
(3) The applicant has passed a nationally accredited home inspection examination or completes an educational program in home inspection certified by the Board.
(D) Every provisional home inspector license issued under division (B) of this section expires three years after the date that is two hundred seventy days after the effective date of this act. A person licensed as a provisional home inspector who does not receive a license as a home inspector during the three years following the date that is two hundred seventy days after the effective date of this act may obtain a license pursuant to section 4768.05 of the Revised Code.
(E) Within twelve months after receiving a license as a home inspector under division (A) or (C) of this section, a licensee shall complete eight hours of education approved by the Board regarding the standards and rules enacted under this act.

There is association bias all over this bill. You force inspectors to train their competition? You cannot have a license until you reach 250 inspections? Come on Nick. Please read it again.

I generally like it because it is so NACHI friendly and has no reference to any other association, but it has some problems, problems that the state has just noticed such as:

The licensing board which has to be in effect to license home inspectors is made up of inspectors who have been licensed for at least 5 years.

Mentoring. Plain and simple. This is a bad bill that we should not support. Inspection licensing should not: 1. have any association bias 2. Put any inspector currently in business out of business 3. As far as licensing goes… There will be about as much consensus within the NACHI membership as within the leadership.


I just want to go on the record saying that members of NACHI are not held to the position that the organization takes in regards to actions outside of the organization. NACHI will never be able to speak for all members - all the time in areas like state licensing, no organization can.

Members should be able to reserve their right to hold opinions and make choices that are not in agreement with the NACHI legislative committee without fear of recrimination or retribution.

Mentoring is the dumbest thing anyone ever came up with. Our studies have shown that the older, veteran inspectors are the worst at following SOP and the newer inspectors follow it punctiliously. The newer inspectors should be mentoring the older ones if SOP adherance is the issue.

Insurance studies have shown that the most amount of claims happen within the first year and after the 4th year in business. The inverted bell curve. Mentoring has to be the number scam in the business. PHIC is the perfect example of how bad it can get. New Jersey a very close second. I just got off the phone today with a US Inspect company. They were training an associate for the past six months. The inspector went out on his own and tried to take Realtors with him. The ride-a-long is bad for everyone. Harvey and I have taken several Chapter members under our wing. We pretty much agree that we can tell how successful one will be very quickly. Confidence is the biggest obstacle. Get your education, a business plan, and some patience. You will be successful if you do it right. Get your 250 inspections and you get to use a logo and then forget where you came from. Then use all your efforts to denounce the same org that gave you a start in the business.
