Opening Electrical Service Panels

Good now that we see there are multiple opinions - let’s consider this from the MOL.

Worker – means a person who performs work or supplies services for monetary compensation but does not include an inmate of a correctional institution or like institution or facility who participates in a work project or rehabilitation program.”

**183.**Every reasonable precaution shall be taken to prevent hazards to workers from energized electrical equipment, installations and conductors. O. Reg. 627/05, s. 6.

Personally - I agree that it is important to see what is behind the panel cover to evaluate and report conditions.

Maybe an interesting point to bring up with our ongoing talks with the gov’t. We all most certainly want to do the best inspection that we can…but …within the law!

A home inspector should not be considered a Worker therefore 183 should not apply, but common sense should prevail…

How would a home inspector NOT be considered a worker?:shock:

If we are not ‘workers’, someone should remind the WSIB so we could all save a lot of money.

However, in this context, I think there could be a distinction made between ‘observing’ the panel and actually ‘working’ on it.

Marcel - I do not disagree with you about common sense.

On the other hand - literal interpretation would seem to identfy anyone receiving payment for “work” or services which is our working livelihood, could be nailed if there was a problem or a complaint from a disgruntled “home owner”.

That is how this whole issue started. Hopefully we can learn by others experience, mistakes or unfortunate misfortunes.

I’m not here to tell anyone what to do, but to simply be aware of how legal requirements could impact us.

Few people understand that our business is very risky. We take risk from the moment we step out of the car into someone’s property. However if only electrician can “work” opening electrical panel, and only roofer can walk on the roof, and only HVAC guy is qualified to check AC, etc… then what are we doing there?
