Remote garage door switch

This is a picture of an operational garage door opener installed at a kitchen cabinet on the second floor of a townhouse. You can see the driveway but not the garage door (no electric eye and also failed the 2 by 4 test) from here! I think the purpose is to let visitors into the home on this side of the house (kind of a wierd layout). I'm not sure I can find "code" for this but I'm calling it as a hazard and that it should be removed. Thoughts (or code)?
