Crossing behind the main - call it a crime or it's just fine?

OK, so that doesn’t exactly rhyme.
I saw two conductors from a “power save energy corp” device mounted next to the panel that were crossing directly behind - although not touching - the 200amp service conductors. Adding to this, in my opinion, one of the mains was a bit overstripped.
Would you make a stink about this? The pink wires could easily have been routed down and around instead of this shortcut behind the giant potential energy sticks.

How do you figure they are any different than the conductors already behind those conductors?

I don’t figure. I don’t like those either, but these are closer. More egregious. Do you generally call out ANY wires crossing behind the mains as in need of correction, or is this just bad practice? We’re not code enforcers (uh oh).

The insulation is typically rated for 600 volts and operating at 120 volts.

Judging from the sloppy work visible in the photo there are probably other more serious problems with this panel.

It was a crowded panel and a bit sloppy, but surprisingly no neutrals doubled up or missing bushings or other real problems.
I just wanted to get others’ thoughts on snaking wires behind the mains. These pink wires just laying on the breaker wouldn’t let me go. LOL. Frankly, that would be the scariest part, the install when you’re passing those wire tips behind there. Once it’s in, it’s not “wrong.”
