i have a question, we have a new home. about 6 years old, just realized i could have killed in the bathroom because there is no gfci installed from the builder in any bathroom? there is one in the kitchen. can i make something out of this? can this be filed against them? can i take them to court?

The device may be located somewhere else. It doesn’t necessarily have to be installed in the bathroom. You can verify this with an inexpensive testing device that can be purchased at most home-supply stores.

You must be from CA :D, why would you need to sue someone? No one has been hurt to this point. Now that you know about the potential condition, it is your responsibility to have it corrected before someone actually does get hurt.

As Jeffrey stated the GFCI protection could be remotely installed away from the bath receptacle location. I would hesitate to consider legal action for a $15 device.
