This bill seeks to provide public protection against the possibility of fraudulent practices in
the unregulated fields of home inspection, mold assessment, and mold remediation. It
provides education requirements and requires liability insurance for home inspectors,
mold assessors, and mold remediators, prohibits certain acts which could lead to
fraudulent practices, and provides penalties for those acts.

I support efforts to protect the public from unscrupulous business practices and I believe
providing strict standards for home inspectors, mold assessors, and mold remediators is
warranted.

However, I am concerned that this bill will have unintended consequences, including
putting some legitimate and responsible employees out of business. The bill grandfathers
some home inspectors but does not provide for the grandfathering of responsible and
experienced mold assessors and remediators. This will likely put employees and
companies that cannot complete the bill?s education and training requirements by January
1, 2006 out of business.

Additionally, the bill is somewhat ambiguous and does not provide clear guidance to the
industry in some areas. For example, the bill does not establish clear educational and
examination requirements. While this bill requires training, it contains no specificity with
regard to what kinds of curriculum and/or standards are necessary for home inspectors,
mold assessors or mold remediators. Further, the bill appears to arbitrarily require high
school and college degrees while presenting no clear reason why.

Finally, the bill requires mold assessors to maintain a mold-specific insurance policy and
in-contracting mold remediators to maintain a general liability insurance policy with a mold
insurance pollution rider, both in an amount of not less than $1 million. There is some
question as to whether these policies will be available by the required date of October 1,
2005. There is a further concern that this will have the unintended effect of allowing
insurers to deny payments for mold claims under a homeowner policy if work on a home
has been performed by a mold assessor or remediator.

Because I agree with the bill?s sponsors that additional consumer protection is warranted
in these fields, I have directed Secretary Diane Carr of the Department of Business and
Professional Regulation to work with various stakeholders during the interim to develop
proposed legislation. I encourage legislators to participate in this process and hope that
they will work with the department to find a solution that protects the public while providing
a constructive business climate in which legitimate and responsible Florida businesses
can compete.

For the reasons enunciated, I withhold my support for House Bill 315, and do hereby veto
the same.

Great job everyone, although I am not in Florida, I was still interested in this issue.


As for what to do now, how about enjoying the fun and sun in Florida.

I assume, of course, you mean after you have sent a nice note of thanks ![eusa_whistle.gif](upload://jDjRTI67WYP0oRBoAiUfREM5WMO.gif) Not only a courteous gesture but it shows how professionally, we as inspectors, run our businesses. Especially if done via regular mail versus email.

Shoot it could even turn out to be good marketing After all, you will be putting your company name in front of all those assistants that read the mail.

I would like to thank you, Blaine, Gary, John, and Joe for doing an outstanding job keeping the pressure on those that were in favor of the bill. For those of you reading this post, the original proposed bill was association biased and inspection school favorable.

Let the troth be known, I had absolutely no problem with the final HI part, the mold had to go and for that I opposed.

With that all being said, there are less than 7 months before the next legislative session. The foundation that NACHI set is strong and we will no doubt have more legislation proposed like it has been for the past 14 years. This time we will have the ball in our court.

You just opened the door (something like first blood)

Don't go too far out on a political limb with out giving us "the rest of the story"

My house rep for my district is working on an HI bill at this time.
My position is only that my emails before and after the veto with all the supporting doc and personal opinions are being addressed. I sense a common ground.

This all has happened since we spoke on the phone so you might want to hold off for a while so we do not get two bills going at the same time that are very far apart. Seems that the "non association" inspectors also have made their point with emails and phone calls. (More of them vote than us) also some large home builder corps spoke their piece. Just goes to show you how some of these things go

Granted we are only in the "talking (email)" stage but ....................

The rest is guessing on my part and there is no need to put something out that is not fact. Like trying to pin down a politician is hard. They all say they agree with you and will take care of you.

The quick bottom line -- Mold --- Grandpa -- State Testing --- No written public qualification statement -- are issues that are hot

Seems Bush opened the door for some sort of a taskforce or something

Wish I knew something other than roomers (Like what does "open the door for" mean???)


Perhaps is the time for us to all get on the same page

If any of us go too far off the current elected party lines we will lose just like the bills for the past years. (they did favored the wrong party from a vote point of view)

I had to re read his veto to begin to understand the big pix and this point

I seem real clear now -- (tell us why a high school - collage - diploma is relevant etc.)

My opinion Mold and HI are going to stay joined at the hip because this is how some of the corp interest want it. There is just not enough $$ for people to live doing mold only so they need us. Just my thoughts
