Really? You went from “possession” of the device being the law. Now you want to try to debate the source of the software? Yes - They’re using FLIR software. The statement “The software is licensed, not sold. All rights reserved.” is pretty unambiguous.

Owning a smartphone with KODI and EXODUS does not give you the “right” to download and play whatever movies you want, just because you’re getting them from someone other than the publisher.

If you want to do it - go ahead - I’m not your mom and you don’t need my permission. If you think you have a “right” to do it because you own a piece of hardware, you don’t.

#2 I have no idea how these devices are being hacked.

If they are stealing software developed by Flir, it is theft (as you state).

If someone is developing their own software and installing it in a Flir camera, Flir has no ownership of the program and it is not theft.

I am simply pointing out the elements of proof. If someone is stealing Flir programming from the camera or elsewhere, modifying it and selling it for consideration, it is theft.

I am only posting a legal “argument”. I do not agree with the hacking and I do not agree with the manufacturer’s dumbing down their product. It is just a marketing ploy. It is there business plan, and their business.

Further more, it took Nick Gromicko to lasso and tackle [Homesafe patent troll](Court Says InterNACHI Can Countersue HomeSafe and its President Personally), Mr. Seddon.
Not one of the Infrared camera manufacturer’s had the gonads to pursue to this patent infringement idea end though the courts.
To bad.

Getting back on topic, software, and the legal points of software. I fully agree with you.

If you develop, or anyone else for that matter develops software that works in an infrared camera, a machine you own outright, than that software becomes the developers and they choose to do with it as they please.
If they wish to offer it into the public domain, or for a fee, the decision is yours/theirs and yours/theirs alone. As long as it does not infringe on other patients.

If I place a Ford engine in my new Chevy Colorado Z71 Midnight Edition, I am not breaking the law. If I wish to replace the software I am not breaking the law. What I might be doing is effectively limiting my warranty and recalls, but that would be about it from what I can tell.

I have spoken to several mechanics that own dealerships because I want to lightly modify the truck without opening up the engine to do so. The OEM software regulates timing, fuel, intake, exhaust, and sifting and that revolves around the Chevrolet warranty.

I could be wrong but I think Chucks argument revolves around, sense the equipment is Flir’s, only Flir has the right to any software that goes into running the machine they had manufactured without an agreement from the owner. It would certainly be an interesting argument to watch unfold through the courts.
